I wondered if anyone has any thoughts on this situation.
I booked a hotel package with Superbreak that included rail travel to Edinburgh. The trip completed two weeks ago.
I paid for the trip through a travel agent who sold the Superbreak package.
I have just found out that the hotel has now charged the cost of the hotel stay to my credit card (they asked for my credit card on arrival as I thought this was normal practice).
So at the moment I have paid twice for the hotel. I am trying to contact the hotel for an explanation.
However, I guess that as Superbreak has collapsed and have not yet paid the hotel, the hotel is bypassing the receiver and taking the money from me without actually informing me. Effectively, passing the problem on to me to make a claim to ABTA.
Has anyone comments as to whether the hotel is acting legally - they have not informed me about making the charge. I have contacted my credit card company and they were no real help.

Just an update on this case, that has now actually been resolved. Some people have asked for more details in private messages.
My original payment to Superbreak was made via a travel agent using my Visa debit card from my main bank.
The hotel accepted the Superbreak vouchers as payment for the stay and the holiday completed with no issues. On checking in at the hotel, they asked for my credit card. This practice I took as being normal for any extra purchases, etc. My Visa credit card is issued by a different company i.e. not my debit card bank.
Two weeks after completion of the holiday Superbreak went into administration.
The hotel then (almost immediately) charged the full cost of the hotel stay to my credit card - they did not inform me about making the charge.
I initially thought that the hotel was acting incorrectly by trying to bypass the Superbreak administrator. ABTA also told me the hotel was in the wrong.
I spoke to the hotel and they told me that Superbreak had collapsed and had not paid the hotel for my stay.
I filed a dispute with my credit card company who investigated the situation and eventually told me that because I allowed the hotel to "see" my credit card on arrival then I had implicitly given permission for them to take the payment - even though I signed nothing and was not told of this possibility. They said the hotel was claiming via a “Subject to Final Audit” clause.
I had talked to my debit card bank previously and when contacting them again they said they would refund the money to me under failure to supply goods clause (or something) and would perform a chargeback to the travel agent who I originally paid.
This all happened and the travel agent has now claimed the money back from ABTA under the Superbreak ABTA policy.
In future I will use the same card for initial payment and hotel presentation – if I had done this the claim would have been a little easier, I think?0 -
