  • When costs have been awarded, where do these come from - direct from the PPC or via the court once Excel have sent to the court?

    A letter arrived yesterday stating that Excel had till the 20th to pay the costs - so would they have sent this to the court first?

    How long would you advise to wait before contacting the court to say it hasn't been received?

    You should receive a cheque from either Gladstones, (from their clients' monies account), or the PPC, unless you have given them your bank account details for a direct bank transfer.
  • Excel have stated that it is with their accounts department and it will be dealt with in the next 7 days - there is nothing more they can do. The order stated payment has to be made on or before the 20th December.

    I have sent an email to the court on their instruction explaining the situation.

    The money isn't the issue - I would just like to cause Excel some problems and crap to deal with.

    I have also forwarded to Excel the e-mail that I sent to the court so they can see that the courts have been informed.

    See what happens next!!
  • Spoke to Excel on 31st Dec, and they have claimed that the cheque was raised on the 17th December, but it needs to be signed by a Director who amazingly haven't been in the business since the 17th December!

    Have been told by Excel it will be resolved within 7 days (seems to be their standard response), so have verbally informed them that I will be contacting the courts with a second update (which I have just e-mailed over to them).

    Has anybody else had any issues obtaining costs? As I mentioned earlier, it's not the money it's seeing if we can cause Excel issues - could they end up with a CCJ against the business for non-payment?

    Unfortunately we tend not to get too much feedback once a case has been won, so I don't know if this is a common problem or not.

    You could always issue the scammers with a LBC to focus their minds. Don't forget to include a bit about what will happen if you succeed in getting a CCJ awarded against them. :D

    The judge has ordered payment and they have failed to comply with said order.

    If you have or can get the judge's contact details you could write to him/her direct. This smacks of contempt of court to me.

    Well done on your win. Have you complained to your MP yet?

    An LBC & SCC is not the correct route for enforcing a costs order. I suspect that the OP will get paid eventually but if they wanted to cause maximum hassle for the PPC they could apply for a Warrant of Control which gives court bailiffs the authority to seize goods from the defendant's home or business to sell at auction. The fee will be added to what they already owe.

    the MCOL site tells you how to enforce these things and the Warrant Of Control is the method by which it is done, it tells you that, so no idea why you are asking us when the MCOL site gives you all the FAQ,s

  • I have received a letter from the court today and they have said to follow enforcement procedures and having just spoken to the court, have completed the Request for Warrant of Control, and have sent an e-mail to Excel giving them a finite date before this will be submitted to the court.

    Hopefully they play ball and pay by the date - if not they can expect a visit from the bailiffs to recover the small amount - again not the money but would be good to cause them hassle!!!!!

    It's a pity that as per a personal claim that it would lead to a CCJ for non payment of an order and cause that person issues with credit for a number of years, that this will not have the same effect on Excel Parking Services.

    Again it isn't about the money but the hassle it can cause Excel!

    Excellent!

    I think there could be an excellent business opportunity for a firm of bailiffs to offer a deluxe service by wearing body cams & offering video footage of them actually enforcing the Warrant of Control to give the debtor that extra sense of satisfaction.
