    How much were the costs for?

    If they dont play ball with the court officers, who add a fee for visiting, there is potential for it to end up over £600
    At that point you can transfer it to the High Court and then you have the real, break the door down bailiffs in play.
  • The costs weren't big - only £45 - but it is the sheer lies and audacity that they think they do not have to pay that I have done this. It has cost £110 to take this action which I will get back. If it was me or you and we had not paid I am sure the CCJ would have been winging its way to us by now - they had until the 20th December to pay and gave some BS story on the phone - I fed all this back to the courts who said the only way to get the money is to apply for the warrant to get it back.

    So that is what has happened!!!

    Just got back from Birmingham County Court and................

    WE WON!!!!

    Excel sent a solicitor from the local area and eventually when the District Judge invited us in, he looked at Excel's own evidence and threw it out on their photos as the car park was inconsistent with their white lines, so he basically said if half of the car park does not have white lines how can you say where the car was parked was a restricted space so turned them down on those grounds alone!!!!

    Didn't even get into anything else - he questioned their solicitor who didn't really have a leg to stand on - we didn't say a word and their claim was thrown out!!!!

    Request for warrant of control

    I have just submitted a request for a Warrant of Control to the local court for Excel failing to pay the ordered costs, so hopefully in the next few weeks the bailiffs will be knocking on the doors of Excel Parking Services.

    It's a pity that as per a personal claim that it would lead to a CCJ for non payment of an order and cause that person issues with credit for a number of years, that this will not have the same effect on Excel Parking Services.

    Again it isn't about the money but the hassle it can cause Excel!

  • EMAIL SENT TO EXCEL PARKING SERVICE LTD THIS MORNING

    To Excel Parking Services

    For failure to pay the costs of £45 based on the order of Deputy District Judge XXXXX on the 6th December at XXXXXXX County Court, I am now informing you that a Request For Warrant of Control has now been submitted to XXXXXX County Court to recover the awarded costs and any further court costs that may be imposed by the courts/bailiffs for non payment.

    There is still an opportunity to pay the original costs of £45 if you contact me on the number below and we can arrange a bank transfer to avoid incurring further costs.

    However once the warrant has been issued and bailiffs have been instructed then the cost will be in excess of the £45 awarded by the Deputy District Judge.

    Please call me today to settle if you wish to do so.

  • So amazingly after submitting the Request for a Warrant of Control and paying my fee, and Excel receiving the e-mail I posted above, on Saturday morning a cheque arrives in the post for the costs. Dated the day after I submitted the paperwork to the courts and posted the day after that.

    Had to apply to the court this morning for a refund so hopefully that will be sorted soon, but they have now paid. I do think they have deliberately waited for me to pay the fee to then pay the costs as they know they won't have to pay that now but is a little inconvenience to me. But their cheque is here!!

    Shows how much they were lying to me when they said the cheque had been drafted on the 17th December and needed a director to sign it off - the cheque is dated 10/01/2019 - lying bar stewards!!!

    Only cash the cheque when you are sure you have your refund of the warrant...
