I don't understand what data breach you believe occurred.

two agents discussing the sale of properties they're marketing?

IANAL but I'd say it was a clear breech of the new Data regulations.

    In what way?
  • The data breach is letting agent 1 know I'd made an offer without my permission.

Like I said, they knew my property was on with the same agent for the sale as for my potential purchase- so they must have looked my address up on Rightmove.

I don't see it, sorry. can you even prove it?

I doubt they'd have bothered to do all that; it's far more likely it just came up in conversation.

I'm currently in the process of buying a flat

    so nosale involved here then?

and am interested in two separate flats with two agents. I'd made an offer on property 1 which was rejected and then subsequently put in an offer on property 2. In the mean time I told the agent for property 1 that I would review my offer and consider whether to come back with a counter-offer. The offer on property 2 was subsequently rejected so I put in another offer on property 1-
fair enough. 2 offer made both rejected. negotiations ongoing

at this point I was told by the agents for property 1 that they had been approached by the agent for property 2 to let them know that I had put in an offer.

and this 'scuppered' you.... errr 'negotiation' how?
EA1 would still want to facilitate the sale of their client's property.

Surely it is unacceptable to do this without asking my permission?

Personally I think there is more to this story than we are hearing.

At no point did I provide agent 2 with the details for agent 1, so they must have had to do some Rightmove snooping to find out.

I have absolutley NO idea how EA2 could use Rightmove to determine
    a) what other properties you had viewed or
    b) that you had put in an offer on another poperty
    You must have said something.

Would appreciate any advice as am on the brink of making a formal complaint as it may well now scupper my sale with property 1.
    Formalcomplaint is pointless.

Go back to EA1, explain you had an offer rejected by EA 2 and that you still wish to purchase property 1 at £X.

EA 1 will be only too happy to facilitate a sale and ean their commission!

I am totally missing something here. Correct me is wrong.

Agent 1 is marketing a flat.

Agent 2 is marketing another flat.

You are selling with one of these agents? (from #14, although confused and not sure who 'they' are, and also a tad confused re it scuppering your sale when I think you may mean purchase?)

So why would Agent 2 let Agent 1 know? Did they know each other outside of work and randomly have a conversation saying someone called 'Fletchasketch' put an offer on a flat today and the other said OMG they put an offer on one of ours too?

This is the bit I'm missing - why/how. I have just woken up after a lunchtime snooze at work so may well be missing something obvious!

Surely it would be beneficial for them both to know about you? In your shoes, I would be playing one off against the other. I would have made it perfectly clear I'd be buying the one I could get for the best price.

I just don't see how this could happen unless EAs 1 and 2 are one and the same. Even if they have different names, they could be affiliated somehow such as be members of the dreaded Sequence. Bit of a stretch, maybe. It seems more likely the OP has let slip they have also offered on another property though surely that does not justify these EAs collaborating?
  • The purchase of property one may still go through- my issue is that by letting them know I'm negotiating on another property they are going to doubt the seriousness of my offer.

As earlier- I did not disclose my agent, but did disclose that my agent was the same for my sale as potential purchase. By looking up my address, they can therefore see both.

I've read their privacy policy extensively- and at no point does it say they have the right to disclose personal information to a third party agent- hence data breach and complaint.

I'm curious- what exactly do you think I'm not disclosing? What would be the point on an anonymous forum?

I think you're concentrating too much on this 'data breach'. No-one takes offers seriously until atleast a valuation, and usually it's only at exchange.

So you have had an offer accepted on Property 1? Your first post suggests otherwise.

Read my last post - use it in your favour. I have no idea why it would scupper the seriousness of your offer.

I don't think you're not disclosing something - I'm just confused full stop!

So you are selling through Agent 1? And told Agent 2 you were selling through Agent 1 and that you had offered on another property?

Or - I think what happened is this:

You offered on a second property with Agent 2, providing them with details of Agent 1 as you are selling through Agent 1. Agent 2 rang Agent 1 to confirm your position and Agent 1 said oh, they've offered on a property with you too? We are currently in negotiations on another property with them.

That is perfectly normal. Seems to me you shot yourself in the foot, not either agent. Of course they will contact your agent to check you are selling. I have always had to provide details of my selling agent and the agent I'm buying through will contact them to establish that I do actually have a property for sale with them (and I would expect a buyer at that stage or why bother offering on a property in the first place).
