PCN for Parking Wrong Vehicle

Hello,

Vehicle A was parked in a hospital car park. PArking was paid using PayByPhone as has been done before.
Received a PCN!
When PayByPhone was checked, on the day of the appointment, Vehicle B was the one that is set up on the PayByPhone account.
So, parking has been paid for, but just not for the vehicle that was parked (captured by ANPR.) They would be able to see that the reg of the car that is linked to the PayByPhone account never went in their car park.
PCN is from ParkingEye.

    Was the PCN received by day 15 & does it have the POFA/day 29 para on the back?

    Simple answer to your question is yes and yes.
    I've used the newbie template before, but wasn't sure if applicable here, or if I should contact the hospital directly?

    (I had success with that last time)

    So you dad has received the PCN.

    It is important to keep the roles of keeper and driver clearly separated.

    Send the template appeal in the name of the keeper.

    Edit your last post to remove clues to the driver's identity.

    Edit your opening post similarly - it was the driver who parked...

    Contact PALS (not mentioning you've done this before) in Dad's name, NOT yours.

    One way to win this at appeal (as an alternative to the template, and a winning stance) would be to appeal initially in Dad's name as registered keeper, saying you are the lessee/hirer of the car, giving your name and postal address.

    NOT saying you were driving, just 'lessee/hirer' - it's a bit of a stretch but not a lie.

    If PE ask for proof, Dad can email them (to their info@ email) a letter saying he leased/temporarily hired the car to you between xx date and xx date, and he signs it and maybe you counter sign it under the heading 'lessee', again with dates, probably best dated prior to the event...

    You then get sent your own Notice in the coming weeks (PE will do that) and you can win by appealing as 'lessee/hirer' and saying PE have failed to comply with para 13/14 of the CoP. That wins at POPLA.

    I'd like to see that tested within a 'family car use' relationship. I thought of it the other month, and could be a way out, that doesn't involve any lie, but does remove an older rk out of the equation whilst giving the person who wants to appeal, a way to make it work.

    I think PPCs are fair game for that sort of grey area appeal; like I say it's a bit of a stretch but their entire modus operandi is a scam, so we fight with fire here.
