  • I take your point Umkommaas but the inference was I was willing to pay when I expressly said 'no way am I going to do that'. I just wsnted to play safe if my appeal, writing , whatever, got rejected, that the charge didn't escalate :)

    Anyway thanks both you and coupon-mad hsve reassured me on this....

    Always keep your appeal channels to the PPC open, but no need to fire one off prematurely. However, should you be approaching the PPC’s 28-day deadline, go ahead and appeal.

    This is the general advice I give in terms of making your initial appeal.
    Make sure the initial appeal is sent to the PPC by their deadline date, normally 28 days from the date on the NtK for a BPA Operator, (21 days for an IPC Operator, but no POPLA for IPC Operators), otherwise you can kiss goodbye to POPLA.

    Also, equally important in the submission of the initial appeal, you follow precisely the method by which they require you to send the appeal. Preferably do it via their website appeal portal (if that’s the method they require). But if it says by email, don’t send it by post (or vice versa). If it asks for the keeper’s name and full postal address - give it, don’t provide an email address instead, or try to be clever with a M Mouse, Orlando, Florida!

    Be wary of any drop down box if the appeal is via a website appeal portal, that defaults to ‘I am/was the driver’ - make sure that isn’t showing when you press the ‘Send’ button.

  • Sorry, just a final question but to put my mind at rest.ECP state on the PCN they obtained my info from the DVLA as it was 'reasonable cause'. Clearly they have interpeted the footage of the reg in Leicester as a V when it looks more like Y and assumed its my reg.

    I'll definately be putting a complaint in to dvla and bpa regardless ..... but is this misappropriation of data if they are allowed to get info from dvla?

    Yes it is, they had no cause to get your data. It's misappropriated. Big complaint, drop them in it.

    Hi all - just a quick update......my emails are bouncing back when I Send on to Steve in the BPA. Is there a different address I should be using? (Also David Dunsford no longer is the contact at the DVLA, though he has responded to me to say he is forwarding on to a colleague - as soon as I find out who that is I will let you know...)


    On a side note - I also noted the PCN was issued to the wrong (ie old address, not the one registered with the DVLA!!)

    Maybe that Steve has changed his internal email address to avoid direct contact from forum-assisted motorists. The above general email address is not as direct, but hopefully your header will be sufficient for him to have it passed to him.

    I wonder if David Dunford has had enough of this now and moved somewhere ‘safer’ within the DVLA :)

  • Good morning all, to update you I have had a reply from Steve at the BPA who also confirms he remains the lead contact for these matters, is happy to help and was aware of my case via this forum!

    He has spoken to Euro Car Parks who have confirmed my contention and his assumption. Namely that they have made a mistake issuing me with a PCN which should have gone to another motorist.

    I've been told an apology letter will be dispatched to me very shortly from Euro and his contact there has also asked that her personal apologies be conveyed as well. So I will await that.
