turns out the 2nd claim was related to a hire car which was allegedly in the same keepers name on the date in question

i will start a thread on this - but can i ask if there is a rule that all they have to round up all claims into one?

no there isnt , but you should ask the judge to use their special poewers to consolidate all claims into one, which has been discussed on here many times before

you do this at each and every stage on all claims until they are all merged by the judge, so in the defence and writing to the court as well, plus the WS also (stopping when the judge has merged all claims)

think of it as a different abuse of process and plan accordingly

No, but there is wording to use to ask the courts to consolidate the claims into one hearing. You will find that wording when you search the forum for:

two claims? abuse of process consolidated

You need to note to REPEAT that wording you find at EVERY stage, defence, then DQ, WS - all the time, and with a covering email or letter addressed to the Judge each time, till a Judge takes it up and agrees.

I got a reply for the SAR request, and they want a copy of the V5 for the given VRN

Problem is the defendant is no longer in possession of the vehicle, was sold more than a year ago and doesn’t have the V5 - now can one then prove past keepership?

Also for any hire car related PCN - how would an SAR requester prove the relationship to the given vehicle ?

Sent them a copy of your County Court Claim Form.
That has the proof they need to confirm they are sending your data to the right address.

    Hi all

I had an email from CC saying that to consolidate the 2 claims I have to make a “fee paid N244 application”

Can I ask if this is right and what the “fee” will be? After a quick google I can see these upward of £100!!?

Courts often try this but that's come from the CCBC, probably a clerk instructed to tell everyone to pay a fee if they ask for permission for so much as breathing!

Are you eligible for help with fees? If not then bide your time and try the SAME WORDS AGAIN at the later stages, DQ, then WS & evidence, until the LOCAL Judge realises and sees your covering letter to his/her court. IMHO a local Judge will act to consolidate the claims IF you put a letter under his/her nose at WS/evidence/costs schedule stage.

Thanks Coupon-mad, no not eligible for help with fees unfortunately - and yes it came from Northampton CCBC.

Is a covering letter part of standard docs/process at those stages or will that be an additional thing from me? If so any tips on wording it?
