  • I emailed the SAR over a week ago and I have had absolutely no response from them. Do you think it is wise to send another email or just leave it alone?

    Also, I still haven't had any response at all about what I wrote for my defence. I realise I still have until the 17th to submit but wanted to make sure I have plenty of time to refine before the submission date. Just getting nervous. Will there be any advice coming from anyone on the defence?

    They have a month to respond to a SAR.

    They won't be rushing - there's no money in it for them.

    Indeed, you know they have 30 days to respond, and they dont have to respond - its better for them to take their time

    As for comments on the defence, this forum is inundated. if youve just copy and pasted from another source, show us your source so we knoiw how good the starting point is, at least.

    I didn't copy & paste per say but looked at the examples from the newbies page from defences there. I just don't feel confident that it all pertains exactly and if it's enough...
    I realise there are a lot of people needing help but I got the impression from what was presented that IF you were unlucky enough to be brought to court that you would have lots of help backing you. Just feeling really unprepared as I've never had to go through anything like this.

    you may get help on here but most of it are legal issues in your case and very , VERY few people here are qualified or knowledgeable to help you with legal issues, a handful at most (they could spend all day every day just doing that on here for no financial reward , like you they have lives to lead)

    the rest of us help out with common sense and basic facts or point out stuff you could have easily found out yourself, like the 30 days for a SAR request , easy enough to google, so if you complain that after 7 days you havent had a reply, the regulars here think , not surprised, when they have 30 days to reply by law

    we are helping dozens and dozens of people, I havent seen you post on other threads helping those, we appreciate you have a life but so do we, the more that help the easier it could be, plus this isnt a legal help forum, its about parking charges, not court cases (read my signature)

    so if somebody with a legal background spots your defence and uses their red pen on it, or says its good to go, thats fine, but this is a self help forum and its only as good as those who volunteer their time here, there are no paid advisors, plus you havent paid anything for this advice you have had

    chill out and hope that somebody with the correct knowledge helps you , because its pointless expecting people with no legal knowledge to reply, that would muddy the waters, like my reply

    and remember, we havent been through anything like this either, most people on here havent, perhaps over 90% havent been through this at all and some only the once , very few are solicitors (maybe 3) and few are CILEX trained, (maybe 1 or 2) and maybe a few union advisors or CAB people and a few teachers like CM


    most of the people like yourself are newbies and its their first time , yet a lot of them manage it after carefully reading and using the free advice being given
  • I understand your frustration but your last post is quite hurtful. I wasn't EXPECTING anyone do anything but hopeful for some further help. As I said before I haven't been through anything like this and got the impression from other postings I read that I would receive more help as I saw the marked up versions of the defences. This whole process has been extremely stressful for me and I wasn't trying to be rude or presumptuous as your post implies.

    I did in fact post on the 22nd myself that I noticed they had a month to reply. And again I was only looking for someone who may have had experience to say what had happened when they requested it or their opinion if I should make further contact.

    In addition, the only reason I haven't replied to others was because I did not feel I had enough knowledge or experience with any of it to be helpful.

    There was only one reason why I decided to fight this instead of just pay it (because it is seriously affecting my health). And it was because I completely agreed with what people had written on the forum saying if you just paid then you allow these parking companies to continue to bully others and I did not want that on a principal basis.

    I am extremely grateful to the help I have received and did not mean to seem ungrateful.

    There is a heavy workload on these forums, and no one get paid or benefits for giving advice.
    Sometimes responses may seem rude/curt and sharp, as a result of the high quantity of new posters all with similar issues - dont be offended by it, the aim is for new posters ( or anyone) not to get intimidated, and to keep their money out of the accounts/hands of the private pakring companys.

  • I am running out of time to submit my defence. Can someone just confirm whether or not a summary of what happened in normal English should be submitted with the defence or just the legalese defence?

    the simple answer is - NO

    do what KeithP always recommends and then email the legalese signed and dated defence as a pdf attachment to the CCBC in Northampton

    where you have fallen down on your question is that you have not read the BARGEPOLE timeline of events linked in the infamous NEWBIES FAQ sticky thread, meaning more work for us as I am doing here yet again (sorry to be so frank) - I specifically switched my laptop on early to answer you properly

    what you are inferring is the WS or Witness Statement which comes at the WS & Evidence stage, much nearer your court date in a few months time

    the WS is the plain english version where you get to have your say

    you do this in the way the courts require, following the laid down procedures, hence why BARGEPOLE wrote down those procedures in simple english over 2 years ago

    you will find this much easier if you READ what he has written and is linked in the NEWBIES thread, plus many of his 2018 posts as well (same goes fo LOC123 who has also had advice linked in that NEWBIES thread

    so sign and date you legalese defence, scan to pdf and save it, then attach it to your email to the CCBC which KeithP has already explained on a previous page

    and READ the posts by KeithP that tell you exactly how to do this in simple english, its not difficult, its following procedures already written by others, like making a cake by following a recipe
