Urgent Advice needed

I have a really difficult problem and I desperately need help!

My partner took a loan out for his ex (they were together at the time) for £4000 as she couldnt get any credit herself as she was badly in debt, anyhow he took the loan out in his name and then a week later she ended the relationship with him.
This was over a year ago, and since then she has paid 1 payment. We have a bank statement to prove that she has paid the one payment to my partner but since then she has paid nothing.
We dont have any evidence that it went into her bank account, as he didnt have internet banking then so he took the money out of his account and she put it in her account via her bank.
Is there anything we can do to get her to pay the loan? or is it a case of we have to pay it?
Is it worth getting a solicitors letter out to her? :confused:

  • His name is on the signed loan agreement therefore the lender will persue him for the money owed.

    The only way to deal with this is to first ask her politely to make a payment towards the debt, if she cannot afford to then your stuck.

    You have the alternative of taking her to a civil court; but you would need proof as to the circumstances the money was borrowed and that he did no spend it.

    I think this is a valuable lesson learnt and the likelyhood of him getting rid of this debt is very very small.

    I have kinda told a white lie to her, and scared her by saying we have sought legal advice etc, and before we go to the solicitors would she be able to afford £100 per month instead of the £140 per month, she said she would ring back to sort something out, but that doesnt seem to be happening!

    Looks like this is a lesson learnt! Just a very expensive one at that!:mad:

  • Unfortunately the law is an "!!!".

    He can only hope for her to be dignified enough to contribute towards the debt that she ran up.
