Subject Access info request

Hi out there, newbie n struggling with all this. Hope someone can help???
I recently requested a S.A R. from a debt company called Capquest. They have sent a letter back stating that they want a proof of identy in the form of a drivers licence and a document that links me to my current address. What should I do as I need this info as they recently took a CCJ out and I am defending it as best I can.
Any help please would be appreciated as this company has been phoning my elderly neighbours (via telograme) and asking questions.

    DO NOT SEND ANY INFORMATION

    Someone will be along in a mo to help you with the letters which you need to send to CRAPquest regarding the telephone calls to your neighbours as this is I believe illegal.

    Just a quickie, it's fairly quiet at the mo, cos people are at work, but will give your thread a 'bump' later on if it rolls onto page 3/4. Please don't panic in the meantime, it will get sorted hun.

    Have you got those things? If so then send them copies as requested - they're allowed to make reasonable requests

    Its not unreasonable to want some proof that the correct person is asking for information, otherwise any could get anyone's information really easily. If you don't have the requested info (I don't have a driving licence for example), then send them an alternative.

    Also remind them it's an offence to harass you or your neighbours (sure someone will post the relevant legislation)

    A data holder is allowed to make 'reasonable requests' to assertain the identity of the person requesting the information, however, in this case Capquest is a DCA chasing the OP for an alledged debt. Capquest is obviously already satisfied as to the identity of the OP as it has recently applied for ccj so therefore a request for driving licence and letter is not 'reasonable'

    I agree totally with this.If you are taking legal action they HAVE to provide all the information you request anyway, they cannot hide behind any data protection act (which is what they are trying to do).Don't let them bully you anymore and insist they send the information or you will be making a complaint to the Information Comissioner or if you have got as far as court complain to the judge that they are not providing the information for your defence.I find it quite awful that they will quite happily pursue you for money (and expect you to pay without any proof of their ownership of any debt) but the moment you want something from THEM they hide behind data protection law.Slimebags.

  • Thanks to everyone for help. I will send another letter off to them. Should I just send them a copy of the one I sent last time or is there something else that I should add, It seems like they are just delaying things, Since the first call to my neighbours, I was asked to come to the phone, I have had several letters and a Court paper sent to me so it seems a bit lame to be asking for that ID info now. Just so tired of it all, fights got up n gone. Seems to be 2 sets of rules but cheers everyone. x

    I think you're wrong.

    If the OP had just written to them demanding stuff, then it would be reasonable to get the proof back.

    However as OP stated it was specifically a SAR then that's a different procedure.

    Whether or not their (the debt chasing people) tactics are reasonable is a different question (and I don't think they are and I'm sure there are other methods of obtaining the infomation the OP wants).

    If we just consider the question in relation to an SAR only then I would say my information is accurate.
