Any ideas on how to get round the £50 for a replacement wheelie bin?

    My wheelie bin went missing after collection-so i phoned up the council and they said "It must have been swallowed by the truck" so they sent me a new one free.
    a little while later my neighbour said "Sorry i took your bin in by mistake"!!!!

    They are trying, like a lot of Waste Collection Authority's, to confuse you. The provison of receptacles for the colection of waste is covered by Section 46 Subsection 2 of the Environmental Protection Act 1990 (EPA 90). Barnet seem to be ignoring their STATUTORY Obligations which says they can either:

    [FONT=Arial, sans-serif]· provide bins free;
    · by agreement, provide bins on payment; or
    · require the occupier to provide a reasonable kind and number of bins.

    There is no power to require that bins are purchased from the authority, in this case Barnet. Neither is there a power to impose conditions designed to cut waste.

    The authority also has a duty under Section 45 of EPA 90 to collect refuse/recycling.


    I would suggest that you contact Barnet again and ask them under what Statutory powers they are requiring payment for a waste receptacle (in your case a wheelie bin). They will try and fob you off as they are acting unlawfully and will be relying upon you not knowing the law. If you get no where using the nice approch, ask how they are complying the provisions in s46 (2) of EPA 90 as outlined above. Whatever you do though, do not agree to pay them for a bin unless you think it's a good deal. If all else fails threaten them with the Local Government Ombudsman for trying to extort money unlawfully from a Local Council Taxpayer.

    I've had my bin stolen twice - once when empty (found later dumped without it's wheels - told that kids were nicking them to make go-karts!!!!) - and once when full (it was suspected people operating in our area attempting to get documents for ID fraud).

    Both times my local council has replaced the bin for free - never any mention of a charge, but I do know that people who wanted an extra bin were told they had to pay for it - each household only gets one.

    We do have to use wheelie bins - we can't leave out any other type of bin or rubbish bag, and I suppose the bin has to be a certain design as the refuse truck lifts and empties them. I've also been told that if you overfill it and the lid won't shut then they won't collect it, but this is never a problem for us as we don't throw away much, and most stuff goes in the recycling collections.

    I'd suggest you tyr again - maybe if you speak to a different person you will get a better response! Failing that, get in touch with your local councillor - after all - you pay your council tax for these services so you should be entitled to them!

    For this to be lawful you would need to have been served a Notice by the waste collection authority (WCA - your local council normally) under Section 46 Sub-section (1) of EPA 90. It would be most unusual if your WCA had served you, or any other occupier of premises, with such a notice. Unless this Notice is properley served the WCA are obliged to pick up all waste left out by you, including any left by the side of your bin (This waste is generally referred to as side waste BTW).

    Again this is where many councils rely upon the general public being ignorant of the law.

    When I moved into rented accommodation there was no recycling wheelie bin, told the council and they I would have to buy one. I told the letting agents and they never got round to it while I was there. Simple solution....I didnt re-cycle!!!!

    So if councils won't empty bins in certain areas if they don't have the correct logo's on them.

    How do the people in these areas get on who have covered their wheelie in that stick backed plastic stuff with views / trees / flowers on it then??
