Scs Sofas Are Taking Liberties.

Hi all,
I dont know if im in the right place. But i need some help.I recently purchased a 2 seater and a snuggle chair from SCS costing £1200 this is very expensive but i liked it and i thought what the hell.Well i paid £300 deposit and they said the time scale for this arriving would be up to 6 weeks and i should get it before. They gave me an exact date which was the 18th june 2008 well i waited and waited and nobody turned up.I rang them an they said i have to wait another two weeks (They didnt even give me a phonecall.) Now the thing is i have had enough of waiting its been nearly 9 weeks and i still havent received my sofa.No phonecalls from them no reply to my emails. Am i entitled to a refund of my deposit if i cancel because i think i should be as they have broken there contract which was delivery within 6 weeks.
Any help on this matter would be appreciated

we paid by debit card. Do you think they will let us have our money back. The reason i say this is because they take a deposit just in case people do cancel and they are left with the sofa that nobody else wants.
Am i in my right to ask for the deposit back

My advice would be, irrespective of what they say, to get you money back sharpish! They are teetering on the edge of administration. If that happens you could be in trouble.
You could argue that they have failed in their contractual obligations to deliver the goods on time - it really depends on the terms and conditions you agreed to - read them and build an argument, stick to your guns and don't take no for an answer!

Insist on your deposit back NOW!!!!
I used to work for one of SCS's suppliers. As we imported Italian leather furniture, we had an agreement with SCS that we would deliver to them within 6-8 weeks. It was very common for SCS sales staff to quote 6 weeks to their customers, knowing full well that they were never going to get their goods in that time.
As a company SCS have been in trouble for about 2 years, but seem to be coming to a crisis point lately. Get a refund ASAP before they end up in administration!
If your sales agrrement mentions a time-scale for delivery and they haven't delivered within that time, then they are in breach of contract.
##if no time is mentioned in the agreement, you can still make it a part of the agreement. You need to inform them in writing that you expect the items to be delivered within a set period of time, eg a week, and that if you have not received your items by this time, then you will deem the contract to have been broken and you will want an immediate refund."I AM DEATH, NOT TAXES.
