Tesco Music Download just stole my money! Be careful

Last week I decided to get a couple of albums off the net. I have used the Tesco Download site before so I thought I would go there again. I put the details in, paid my money and went to download the files.
The first track took about 20 minutes to transfer - very slow on a broadband connection. After that I couldn't get any more - transfers would start then stall. Nothing would work on any of the 3 PCs I have here and in the end it told me I had no more download attempts left.
So I gave up and decided to try iTunes instead. Altogether a more enjoyable experience.
So I sent an email to Tesco to ask for my money back. I hadn't downloaded any music (ok, one track) so I wanted a refund. Eventually I got a response. The terms and conditions of the site say it is my responsibility to make sure I can download tracks - and they offer a free test track to make sure. I hadn't done that because I had used the site before with no problems.
I maintain it was the website at fault (interestingly as I type this the website is offline) but I can't prove it. I have sent a few more (increasingly flamy) emails but they are not going to budge.
So they now have £15.98 of my money and have provided me with nothing. As the saying goes, it's not the amount so much as the principle. Thankyou Tesco!
So if you use the Tesco download site be careful. You have no chance of a refund if anything goes wrong.
Does anyone have a clear view of what the law says in this case? Does it contravene any "Sale of goods" laws? As far as I can see browsing the web the law in this area is a bit wooly.

If only I had read this before I tried to download two songs from Tesco...they have taken my money, but no tunes anywhere on my computer....it didn't even start a download...once the money had been paid, the screen just went blank. AAAAAARGH. OK, it was less than £2, but it is the principle of the thing.
And I know if I complain I will get the fantastic customer service I got earlier this year when I purchased a cake which when I got home I realised was well past its sell by date...no response at all.
I would have thought that the legal position is straight forward...I purchased a good from them (ie two tracks) and have not received anything in return...they SUCK.0 -

So I guess I am not the only one then. I have heard absolutely nothing from Tesco since and I don't expect I will. It seems that the rules which govern "fit for purpose" goods have not caught up with the digital download age (unless anyone knows differently) so that's it.
It isn't so much the fact that the downloads fail - god knows technology doesn't always work as it should! It is the total inflexibility of Tesco's so-called "Customer Services". But when I read some of the other posts on here I suppose I am not entirely surprised.
All I can do (and have done) is vote with my feet and not buy anything ever again from them.0
