Your credit card debts totally written off

    That sounds justified now. Zombie, what creditors did you manage to get written off? Did you have to go to court or anything to get them written off?

    Sorry but you are jumping on the bandwagon . There are several threads running on this . I started one in dec 2007 ,and believe it helped many .

    I don't agree with requesting CCA without good reason, ie two credit agencies after you etc etc

    If you signed to take out a credit agreement then you are honour bound to pay it. I don't agree with huge interest charges and agree to claiming those back.

    Also they can still be on your credit record and you can still be persued it just can't go to court - so if you want to look over your back for 6 years then its the way to go!

    Another good argument there. I dunno. I think I'll just pay back my debt. Rayday2, you say you agree with claiming back huge interest charges? What do you mean by that? Just asking for refunds as the interest is high? (I know I sound stupid!)

    Its only a dilema if you want to cheat the system. By all means query a debt you arn't sure about but why try to escape one you do. I'm all for people fighting against unfair practice but this CCA stuff is a step too far and one case I hope the banks fight and win soon.

    Like Rayday, I'm all for claiming back unfair charges as I'm sure I've paid many of my debts a couple of times over through extortionate charges and interest rates but I am not trying to get out of paying my debts. I would only request at CCA because I don't want to go to court, not that I am trying to get out of paying my debts. I have had a very unenforceable CCA sent to me, but I am still paying the debt, I just know that if it goes to court, it would be difficult for the creditor to take further action.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)

    Well you can only really claim back on charges although saying that my parents did get interest written off on a secured loan where the interest had risen without interest rate changes if that makes sense.

    You are not stupid I don't think I was very clear in how I worded things.

    Personally, I don't want to write off my debt. I want to pay it off.

    Also I don't think you'll find that the debt is written off - it just becomes unenforcable. They can still ask you to pay, they just can't take you to court.

    For me a CCA is legitimate to stop them taking court action + I'm all for claiming charges back. But I'm not into avoiding my responsibilities.

    Just my choice of course.

    I agree with you on that Tigert. The debts are uneforceable in court but it doesn't mean that you don't still owe the money. I have a lot to lose if I go to court (my job and my house) so I don't want to go to court. I know that the majority of my debts are uneforceable as I don't remember signing anything for many of them and the paperwork I have from years ago is unreadable. BUT I am still paying my debts and I think my creditors know that the debts are unenforceable so are generally being good and accepting what I am paying them.

    Sorry, I am just into the moral stuff here.

  • i do not as ive said see the problem , however i know 3 bankrupts all discharged and extremely happy,
    now is every bankrupt who went bust for under 100k swindling the system
