I am sorry but your average person does not want to go to court. I tackle DCA and credit companies have even been in the national press over reclaiming PPI and having a go at First Plus on practices but I would hate the thought of court. And I don't think I am alone here it may be logical to you but when you have court letters etc it is a frightening experience.
CCA requests are not striaghtforward at all.0 -
Courts are not scary or frightening places people believe they are becouse they believe the scaremongering some times on here and that is why the dca use the threat of court to extract amounts from the debtor they can ill afford .
at the end of the day if as a debtor you do not pay the creditor takes you to court depending on amount owed this is better for the debtor,
2nd option the creditor sells the debt , they arrange a repayment in most case the debtor agrees to pay out of being harrassed at home or work something he cant afford 3 months down the line they demand it is upped , this is the very reason i refused to waste my time breath dill dallying with dca , they had the option eccept my offer or nothing , or court,0 -
If you had read my post you would see I am on a DMP self managed I am used to dealing with DCA.
Here we are talking about requesting CCA which is not an easy carefree option it is more unsettling than arranging a payment plan as if they don't provide a copy then you have to either pay them or wait out 6 years of new DCA coming on the case or solicitor letters etc etc
I am worried by the way requesting CCA is seen as a way of getting rid of debt it does not - it is still there and can be chased it can stay on your credit history and effect you. I think we should be responsible and point out the pitfalls instead of all this rainbow and skipping solution that is being put forward.
This topic is biased it asks for successes how can you tell anything is a success until the 6 years are gone? Can you guarantee some company will never again try to get the debt?
As I pointed out I had two DCA chasing one debt and had to do it and it has not brought me any answers nearly 6 months on I have had another DCA after me and solicitor letters it is very unsettling even for someone as condifent as me on rights. But thats the difference between confident and cocky!0 -
i did my dmp my self and i am now clear , it is all how you are looking at it .
i said if the creditor or dca cant produce the documents then tough its a game you win , people can ask until there blue in the face you do not pay it.then it becomes pointless.
The staue barred issue is just that they cant take you to court they can still ask and you just say no its quite simple .
BEING IN DEBT IS COMMON , many becouse they are at present managing it do not see themselves as in debt im debt free and owe nothing other than monthly c/tax water rates, and normal house hold bills .
when your in debt you sort it how you see fit with in the law , if i had listened to cab or cccs there advice go bankrupt its the easiest solution i never chose it neither did i make my life difficult when sorting it i had a number of difficult years when my troubles started i paid what i couldnt afford they the creditors said we will give you a little break then , they then would phone we must have another payment and so , then came the dca insulting belittling you asking for unrealistic amounts ignoring your issues harrassing you at wotk etc etc etc .
That was when i had my momemnt contacted a solicitor asked him waht were my choices when in debt ? what could the creditor do? what could the dca do? i then set up my plan and did it my it was not in a cocky way it was my way and me and my family were number one and i couldnt care aless about my creditors and didnt careless about the dca workers and there bonuses they never had any from me .0 -
I'm on the phone to NDR (DCA) as I type, they are chasing a debt for Kays/littlewoods. I requested a CCA in April but still have hadn't had a reply. Stupildy I didn't send it recorded del, arrgghhh! I haev had a notice to proceed from them so rang. They have no record of recieving it. They have put my account on hold for 28 days and have asked me to request it again and pay another £1. I have asked if they have a copy but can't answer that question over the phone. I have had the account for years. What do I do next? Do ask for it again but sending it recorded!!!!Why didn't someone kick me up the backside earlier:mad:

I totally agree with rayday2 the cca route is not easy but the benefits are great. The Lone Ranger has got very good points with regards to how to deal with DCA's and banks although I personally would keep all correspondance. You have to be cold and calas remembering it is not personal and given a role reversal they would be doing exactly the same thing.
Having been in court resently I can say that it is daughting and dependant upon the judge 'not a pleasent situation' I made a complaint against a bailiff and the judge ripped me apart. the best way I can describe it is that the judge rolled me over, rogered me and left me to cry and then patted the bailiff on the back? I am appealing. I am trying not to comment on problems with bailiffs threads untill the appeal because I do not want to cloud issues.
So back to CCA success's, how can you measure it? If you look below I have had success but with the rider tomorrow is another day. Ask me the question in 5 years 6 months time and I will be able to answer yes or no!

May 2008 = <5k of Debt (CCA route -48K, paid off 3K) DFD April 2010
Nov 2008 Lloyds found CCA for 14K loan:mad: New DFD Jan 2016

Kel - good luck with the bailiff. Especially if it's the one i'm thinking of. Just remember that he asked if he could enter and you said no.
