Hi The first thing that jumps out at me is Sky. Can you cancel that and just have Freeview?Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free

Are these negotiations being done on the phone or in writing?
I suggest he requests a copy of the customer credit agreement (CCA) and statement of account.

those CCA letters are all saying they dont acknowledge the debt - officially we've already done that as they told me i had to make a payment to stop any further action so i paid a tenner to stop them sending baliffs round. Dont think i can send one of those letters? is there anything else i can send ? maybe a "can i have a copy of the cca please?"0 -

tried to cancel sky but they said that i was in a 12 month contract n cant cancel it until august - its in calender to cancel in july as they said they need 30 days notice0 -

You can still send the letter for CCA - the "i do not acknowledge any debt to your company" is just for legal reasons. It replaces "without prejudice" on letters as this is now worthless due to a court case ruling. Don't worry about that part.

ok - will get that printed out and sent and see what they come up with. I argued about the debt on the phone and they said it had been reduced by £2,000 as this is what they made back at auction but the person who brought the car wrote to us to ask us why we sold it so quickly as she wondered if there was anything wrong with it and she said she paid more than £2,000 when i called her but wouldnt tell me the exact amount so think he's been stung there but the car company wouldnt tell me either, they said it was none of my business0 -
I would ask the original Finance Company for a full statement of account which will show all costs and fees.
If you cannot find the original agreement then also ask them to send you a copy - we particularly need to know if he took ppi?
I would also then ask the Debt Collector to provide a full statement of account so that you can compare the two.
I know your boyfriend says he gave the car back voluntary but you really do need to know if it was repossessed and he gave the car back willingly or did he actually voluntary terminate the agreement as there will be a difference in what he would owe?
As you say, he is burying his head in the sand at the moment but he needs face up to his responsibilities as they will not go away.
These problems are not insurmountable and there is a lot of free help he can get to sort things out.
I suspect the Car Finance amount is very iffy and could be easily challenged and reduced - but he has to want to get involved?
This is all a black cloud hanging over him at the moment - think how much better he would feel if he tackles it head on and with a little help along the way you both can fight this and put your life back on track.0 -
IF i got that reply from the car company, i'd do a subject access request (SAR). Basically under the Data Protection Act, they need to provide all information that they hold on your (for a £10 fee) within 40 days. All documentation they hold on you should be included so this should include the sale details of the car as this affects the amount you owe. he definatley gave the car back voluntry - i was there when he called and i know they told him he would be better off keeping it but he insisted.
have tried to get him to sort it out - he wont - even tried bribing him with the "if you dont sort this im off" he always says he will but he never does. Was hoping to get some better info from this board then hammer it at him until he does something about it. Am assuming i can send the letters as i dont have to say they're from me and will hopefully start the ball rolling and get Jay to finish it - HOPING.0
