They sent me a 'Summons for non payment of council tax' It says that a complaint has been made (by the council offices) and I have to appear before the Magistrates Court to show why I have not paid the 'said sum'. Its ridiculous. As a recent bankrupt, where do they seriously expect me to get £1,949? I will write the letter, as you say and hopefully this will put a stop to the nonsense

Thanks DD. I have to admit my head is messed up at the moment. I'm stressed to hell over this ongoing rubbish.

Thats ok, no problem. Do you have any letters about the overpayment of CTB and HB or even better an invoice for either ?

Yes I do. One item is a letter from the Operations Manager who wrote to me prior to the bankruptcy. She clearly wrote: The total Housing Benefit overpayment is £4,473.04 The total Council Tax Benefit overpayment is £1109.66
(both amounts were listed in my BR SOA)
They stated also that the CT benefit had been debited against the council tax account.

I have an invoice for the HB but there has been no mention of that as yet. they are just gunning for CT

Yes. There was a gap of about a month where they were (faffing about) doing me a revised CT Bill. Thats where I first saw that they wanted me to pay £240 a month with the incorporation of last years benefits added. I am still not sure what monthly payment I should make so have been paying £100 exactly (single parent)
