How can I thwart a gold digger

Greetings, I have recently discovered that I married a gold digger who was milking me whilst I was working overseas to keep her in the lap of luxury. She has now moved on to her next victim but is trying to go the 50% spouse settlement route through a no fault divorce. Can anyone offer me any advice on how to protect myself? All of my assets are in property and in my sole name and are located in Spain.

As I have posted numerous times the 50% spouse settlement is a myth. It is used as a starting point, using the presumption of equality in a relationship but from there it is balanced for and against each party's contribution. Staying at home and raising children is equal to working but if one person but in, for example the whole deposit, then this would be credited. The length of the marriage is also taken into account as following a short marriage the court would be looking to restore the parties to their position before marriage. In a longer marriage the original input of deposit and such like is eroded.
You need to seek some proper legal advice in relation to your position.0 -

Can't see what difference it would make to the financial setlement.
I'm sure Bossyboots will offer a fuller explanation but basically you don't get brownie points with the courts because of the reason you cite for an 'irretrievable breakdown of a marriage' (this is still the only reason for granting a divorce in this country). That's why it's always best to think of divorce as made up of three compontents (or two if no children involved): obtaining the decree absolut, care of the children and the financial settlement.£16,500 in debt.
New debt free date: 2015 (was 2046!!).

i know her..........get divorced, give her most of your money, and never speak to her again. think yourself lucky that you escaped....and pity the poor next one.0 -

There seems to be no justice we were only married for 2 years on july 18th I found out about the scam on the 15th. She is a well educated brit from Yate in BRistol with a scumbag ambulance chasing solicitor based in Newport Gwent. I figure that I can chill her out as I am resident in Spain and all the assets are here too in my sole name. I need any practical help that I can get as my insipid UK solicitor seems only interested in sucking me dry too. I wonder what protection being in Spain will give me!?0 -

Living in Spain throws a new light on this. Are you "domiciled" in Spain. If you are, then just instigating the divorce could be a problem. You can look up what makes you domiciled on the Home Office website. It would then be an issue whether the settlement should be dealt with accordingly to British or Spanish law. It would be as well to check what Spanish law says before stating your domicile as you may prefer to work under British law.
As you were only married two years, then the parties should in fact simply be put back in the position they were in before the marriage. Ideally, you need a solicitor specialising in both Spanish and British Law. I might be able to get some details next week for you.0 -

Were you able to assist in sussing out the Spanish - English law angles on my case???
I am told now that as we were married in Hong Kong under UK law that the divorce can only be handled according to UK law even if I file in Spain.
I am also told that she can register a charge against my property in the spanish land registry even though she has no ownership entitlement......
