Negligent Estate Agent got me Clamped!!

Agree with that. I would put a formal complaint in to the estate agent. I would also advise the estate agent that you are going to send a copy of the complaint letter to the owners of the house that you were viewing (their client) pointing out to them that, not only are their estate agents stupid and they are getting potential purchaser's cars clamped, but that they are not exactly showing the property in a good light by doing so! Hopefully that will put pressure on them to settle. If they don't, send the letter, if only to spite them.
That said, you don't have a legal leg to stand on, so if it doesn't work you are stuffed.
"Sorry officer, but Jeremy Clarkson said it was OK to drive over the speed limit..."0 -
sorry to put it like this, but, if an estate agent told you it was ok to put your head in a hot oven, would you then do it.
the other poster was right, it is your responsibility as to where you park. It's down to you, nobody else. Estate Agents lie about everything, he wanted you to park there because he would have lost the viewing if he had told you that you couldn't.0 -
If anyone else is viewing in this area - suggest to the EA you will cadge a lift with him in his car.0

A similar thing happened to us whilst house hunting. We parked outside a property we were viewing (on a main street with residents only parking) and were told by the EA that it should be absolutely fine as it was a Saturday bla bla and there ar enever any parking inspectors on weekends. Of course during the 10 mins we were inside viweing the property we received a parking ticket for £80 - reduced to £40 if paid within 7 days or something of the sort. Alas had we got in the car about one minute earlier we might have escaped the ticket as the ink was barely dry and the unsympathetic ticket issuing man was a mere three metres from our car.
Despite getting the estate agents to write a letter to the council saying we had an apponintment to view the property and hence were not yet residents and thus didn't have a permit, we still had to pay the fine :-( We wrote it off as an annoying learning experience and will never ever believe people again about parking in areas that stipulate paying for parking/no parking/permits only etc.0 -
Casual,
Im not sure how you are getting on, but Ive had an ask around at the weekend, and I have some sort of good news for you from someone who lives near there.
Now, the situation is the clampers (Red Route) were brought into the area by a combined effort of the furniture shop and the building maintainance company (Urban Point) without ever asking any of the flat owners if they agreed. The flat owners have even been clamped themselves in the past.
But this is the bit that you might be useful for you. As a result, one of the residents (who if it helps I can put you in touch with, pm me if you want the details) complained to the maintainance co that he should have been consulted as a flat owner and an owner of a parking space (or whatever it is when parking is allocated!) if clampers were going to be brought in. As everyones space is allocated, each flat has the right to let whoever they want to park in their space, and as such is not the desision of the clampers.
As a result of that, the clampers are now ONLY allowed to clamp if you park in the shops 4 spaces, not if anyone parks anywhere else.
Was it Red Route who clamped you? If it was they are very aware that they arent allowed to clamp now and have confirmed this to the flat owner I know. BUT what they have been doing is camping out in the car park, and as they probably saw you pull up with the EA they have seen you as easy prey and clamped you, but they do not have the right to clamp anywhere in that car park other than the 4 spaces that belong to the shop.
Therefore, you need to get in touch with the clamping co and tell them that you should not have been clamped where you were parked, the EA should have as they were in the shops space.
Like I say if it helps I can get more details for you, or put you in touch with Urban Point (the building maintainance co) or the person I know who told me this.0 -
You parked in somebody else's parking space.
You were wrong to do so.
The penalty seems harsh.
Perhaps it needs to be to prevent illegal parking.
You may have learned from your mistake.
Happy is the person who learns from other people's mistakes.
Commiserations on your bad luck in this instance................................I have put my clock back....... Kcolc ym0 -
