Perfume bought on ebay...sent a tester?

Bought perfume on ebay, arrived today, but in a tester box and the bottle has "tester not for sale" written on it. The auction stated the perfume was "new" and "100% genuine", and the picture showed the bottle in front of its box blocking the view so I couldn't see the box properly. Now I wouldn't have minded if the auction actually said that it was a tester and I bought it knowing it's what I want, but as it stands I'm slightly annoyed as "tester" was not mentioned anywhere in the listing.
Am I right to expect something in retail packaging? Or has the seller managed to protect themselves by not specifically stating whether or not the perfume was a tester?

Seems a bit remiss that the listing didn't include that it was a tester - but surely it was a small volume of perfume? That would be a bit of a clue.
My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
Do you want the item at the price you paid?
If not, ask if you can return it at your own expense for a full refund.
If you think, but cannot prove, you have been misled, you can always warn other potential buyers by leaving appropriate feedback

It was a 100ml full sized bottle; I paid a relatively good price for it (I think about 65% of RRP), but had I known it was a tester I wouldn't have bidded as much. I'll send the seller a message about it to see what they have to say

How much does it bother you that the bottle is marked “Tester”?
For a 35% saving I could live with that.
The contents are exactly the same.
In one respect you should be pleased. It is obviously genuine perfume as a fraudster would not have marked a fake bottle as “Tester”.

Perhaps it was intended to be a present for someone else...For a 35% saving I could live with that...

I would be upset if I was sold a bottle that was a tester without being alerted.
I sell a lot of promo CDS and always stated that on my listings.
This seller should have done the same.Third time lucky on WW I hope :j

Be careful selling promos' - I had a listing removed under VERO a few weeks ago for that. There has been a case in the US recently, which although it went in the favour of the eBay seller, it has not set a precendent, nor has it any bearing on UK laws.

Thanks. I've had a promo book removed before so now I list them after the release date and haven't had any trouble since.stevew8975 wrote: »Be careful selling promos' - I had a listing removed under VERO a few weeks ago for that. I don't know the exact in's and out's, but the one I had pulled mine had been on release for years. I think it depends on the tenacity of the record company inolved. It was BMG who had my listing pulled, and sent me a rather polite email requesting that I should not do it again!<--- Nothing to see here - move along --->0
