If you have a claim that has stopped and you start a new claim it is not possible for them to automatically dedust the amount from a new award.
It must be paid back seperately.
SuziQ what course is your son going to be doing? Even at college he may qualify for CTC and CB. As long as he is there 12+ hours p/w and he is not doing an advanced course (above A-level, NVQ level >3)0 -
I have been going through the CAB so that a 3rd party is involved.
CAB was told in Feb 08 that Tax Credit office would put a stop to any debt proceedings until a completely detailed letter was received by myself so that I could read it a decide whether or not to dispute. I have yet to get this letter and guess what arrived this morning -

I am trying to phone them but getting no answer - on hold for hours. So I am off to CAB again and my MP. Hopefully somebody can get to the bottom of this.0 -
Euphemia this is incorrect information either from CAB or TCO. Recovery is not suspended until TCO have received a written dispute against the overpayment.
You can write a dispute to them now saying you dont agree with the o/p and why. Request a recovery reason referral be sent, this will give you a full breakdown of the overpayment. This written breakdown can take 10-12 weeks.
Even if your 1st dispute is unsuccesful you can dispute again - it will state that you have no right of appeal but if you have more information (once you have received the written breakdown) you CAN dipute again.0 -

I'm afraid it can go months without you hearing,then you can suddenly get aletter. A man in overpayments last year told me to involve my MP. The dispute had only just landed on his desk-nine months after I lodged it,and he said unless the MP got involved it would be another 3-4 months before he could look at it as they are so overwhelmed!
At one point I wa given a direct line number,but predictably enough,tht's obsolete now.
If you have appealed than you have to recieve a 'decision' letter before they instigate procedings. Did you send your appeal registered and did they get it? If so just wait for their reply.Tomorrow is always fresh, with no mistakes in it!0 -
Update on my situ I have heard absolutely nothing since writing my last letter - ANY ONE ANY SUGGESTIONS WHAT i SHOULD DO NEXT???????? LD0
