Hi all,
Asking a favor here, have sent a CCA letter to a debt collector/moron and am just wondering if they don't respond within 12 working days i can assume they have failed to provide the documents and the debt becomes unenforceable.
Is this right?
TIA

12(+2) working days after receipt of the CCA request, if they have not provided the CCA then you can stop making payments towards the debt as the debt is in dispute and unenforcable - without a court order.
There are other threads with info and templates availabe for sending after this stage.

Too much is made of this time scale thing . If they come up with the CCA , EVEN AFTER the time limit, the debt can be enforceable so be prepared for that .0

Possibly, Although they have committed a crime after 30 days.
If you follow Rog2's advice (and I personally would), he points out that very few courts would find in favour.
Has anyone on MSE ever been taken to court AFTER the 30 days and lost? The smaller the monkey the more it looks like it would kill you at the first given opportunity.

There have certainly been some cases where the creditor has suddenly produced the CCA after the 30 days and have obtained a judgement.
I can't remember whether they were here on MSE, or on another forum such as CAG.

It is true they have committed an offence after the 12 +2 +30 . But that does not alter the fact,if then produce it, the courts can enforce it. I can not see what action would be taken against the DCA, so they are not really bothered about the time scale .0
