I have had a reply to my letter asking for the credit agreement , statement of account and notice of assignment. The company called First Credit Management received the letter in the office and they dated it 23rd June with a stamp they have wrote back to me asking for me to resend the letter to them but make the cheque for 1.00 payable to Nat west and not them which my original cheque was made payable to them as I thought they were dealing with this. What is your advice now? why are they asking me to do this if they have taken over the debt ? They havent got the information is my first thought or are they using a time staling tactic?

This is a new one. They are suggesting that Natwest still own the debt and they are only collecting on their behalf, I think.
In which case natwest would be the one adding interest and charges.If you've have not made a mistake, you've made nothing0 -
Thanks RAS what do you think I did have one conversation with this company when they first contacted me and they did say that while the debt was with them no interest would be added ?????? Why are they refering me back to Natwest ???0

In some ways Lindy, I do not know, but frankly it is of little consequence as once you request the CCA, the clock start ticking got he DCA.
It is recognised practice that interest is not charged after the debt goes to a DCA.
So I am a bit confused.
Have you thought of ringing NDl as they can ask you questions in a more sensible way than on-line?If you've have not made a mistake, you've made nothing0 -

Sorry - been on holiday so haven't seen this until now.
I think this may be a stalling tactic, but it is possible that Natwest may still own the debt. Have you tried contacting Natwest and asking to speak to someone about your account? They should then be able to clarify if the debt is being dealt with by a DCA and if it has been sold on or still owned by Natwest. I would contact Natwest in the first instance and see what they have to say. I would also make sure that the cheque has not been cashed and that you cancel it if they haven't sent it back.
Hopefully by Thursday (which i think is the 12 working days?) this will be the last you hear from FCM.
I've not come across a DCA asking for payment to be made to another party before. Don't know if anyone else has had this. I have spoken to National Debt line and explained all whats been happening and they say that the DCA must provide the details I have asked for - they think that the debt has been sold on and after 6 yrs it is difficult to get the paperwork I am requesting eg the credit agreement ect ect, they have been really informative. National Debt - they have said to ingnore sending the letter again with chq payable to Natwest at the end of the day FCM are requesting the payment so they have to come up with the paperwork i have asked for the next step --- that will be to make an internal official complaint to the company as suggested by National Debt, they have sent me a lot of good reading material to help me. LD0
