I have to say angel you had that coming to you. First off it wasn't a fraudulent claim....he didn't receive the item and you wouldn't refund him so he's perfectly within his rights. Secondly, he asked you to send to a different address.....you could have just said no or sent recorded to cover yourself.
I followed your other threads in the hope of a good outcome for you but you admitted yourself that you cleared your paypal account so he couldn't get his money back, or rather (in your own words) so he could't do sod all....and also that you wouldn't put a claim into RM because, and I quote " I am also not going through royal mail to claim purely because his feedback shows he poops other people around!!"
It doesn't matter what he does to others, IMO you should have just refunded him straightaway and kept your good name. You (and most MSE'rs) would have done exactly the same as he did if put in his position.

Why would I have refunded him staightaway? I didn't have the item and I have got stung too many times!! every little bit of money I can get on ebay goes towards my unborn son or my daughter! I don't have a lot of money so can't afford to be out of pocket. It was a fraudulent claim because the item had been delivered but the person was not in to receive it, their fault not mine! by the time I had the book back the paypal dispute had gone into processing so I couldn't do anything!! so it was fraudulent. He was agressive and abusive in emails although I had apologised (even though it wasn't my fault!). He has a low feedback score.
he lived in America and the address he gave me was Northern Ireland?! out of goodness I agreed....well never again!
Sometimes I don't make the right decisions but then I learn. But thanks for the vote of confidence!

Angel, unfortunately the wording of your neg means that the buyer might be able to get ebay to remove it but leave his neg to you intact.
Paypal found in his favour, therefore it might be considered libellous or defamatory to suggest he made a fraudulent claim. and liable to removeable under the ebay guidelines.

I'll tell you what I would have done....I would have refunded straightaway and claimed back from RM so I wouldn't have been out of pocket. My hubby has been ripped off a few times too so I know how it feels but it doesn't mean that everyone is the same.
