However this is the purchase of three tonnes of gravel - not a t-shirt in a glossy catalogue. The bags that the gravel was delivered in are designed to with stand a single journey - they may have been damaged underneath when being dropped on to the op's driveway. I can see the merchants can request that the op repack and return the gravel to them, completely at his own cost, plus they could charge a restocking fee.

If I ordered the wrong thing from a builders merchant, I'd never expect to be able to return it - and certainly not easily.
  • After several discussions with the builders merchant we settled on exchanging the gravel for a £30 fee. Not a bad result since it was my own fault not theirs.

Thanks to everyone for your help resolving this.

DSR regulations are very specific about return costs. If the vendor states in advance that the customer is liable for return costs then the customer has to pay, otherwise it is the vendor's responsibility to arrange for collection. Re-stocking fees are not allowed - any refund given under DSR right-to-cancel must be full and include the original postage charge. It is really important IMHO that consumers understand their rights under DSR.

b.t.w. I'm glad that the OP got a result he was happy with.
