Capital One debt

Hi all,
I wanted to ask something as I'm annoyed that Capital One did this last year......my partner became unemployed, we told all the people we were paying but some chose to ignore us. Capital One kept on phoning and making us agree to payments we just couldn't keep too, we felt so bullied by them we got some advice from the CAB. They kindly called Capital One but all this time the credit card were still adding on interest charges, even though we'd told them of the unemployment (and my disability).
So the CAB arranged for us to pay £1 a month until we were back on our feet but we were under strict instructions from the CAB to forward any more calls from the credit card to the lady who was helping us out because Capital One were being very unreasonable when they phoned us and didn't stop hassling us.
Now Capital One have sent us a letter, saying our £1 per month agreement is up and they want to 'discuss' new payments. So they are again contacting us and not the CAB, but aside from that, I started to think the other day the card company are cheeky because we'd told them we were getting benefits and asked them to be patient with us, and all the time they were adding on charges (late payments, interest etc), so most of the amount owing isn't what we'd initially used/borrowed from them.
Am I right to feel annoyed or do I have to live with it and just pay them?

Sorry about the problems you have been having.
Make sure you have records of the balance with Capital One when you first advised them of your change in circumstances.
It would be reasonable for them to suspend interest and charges at that point and agree a repayment plan with you.
If your circumstances have now changed it would not be unreasonable for Capital 1 to ask you to increase the repayment of the orginal debt (but not the fees and interest since you first advised them of your difficulties)
I think the CAB are going to be best placed to advise you what to do next.

I will go through the card statements and see how much they've put on. I know when my partner became unemployed and the CAB should have it on record when Campital One were notified - I only spoke to them <Cap' 1> on the phone when they called to give us grief!
I appreciate your replies and yes I agree they are vultures!!!! You wouldn't believe the bully tactics they gave us when we were at our lowest, even the CAB couldn't believe it and had to tell them to back off
Now I know why they kept on giving us a bit more of a 'top up' to our limit, how stupid I was. If only I'd had the forsight to only buy with any cash we had then we wouldn't have gotten into the mess we did.
At least I'm a few years older, wiser and happily logging onto this fab website each day to get more advice and information!!!!

Remind me to take out credit from a company, and then moan when I can't pay back what I've borrowed due to a change in my circumstances which the company isn't responsible for.
I'm all for money saving - I'm also all for paying back what you've borrowed.
It's Capital One in this case. I have no link to them whatsoever. You borrowed from them, and signed an agreement that had TERMS and CONDITIONS on which your account was administered, and on which your money was borrowed.
Sorry to rock the boat but I believe Capital One are entitled to their money.0 -
Well there's always one who thinks they know all about a persons history through a message placed by the person seeking help!
The money borrowed from Capital One makes up a tiny part of the total now owed and that part of it I'm quite happy to pay them back, I also believe in paying what is owed.
The trouble I have is paying them nearly 2 grand in interest charges and late payment fee's when they knew of our circumstances, choose to ignore our plee's for help and carried on putting charges onto our balance.
Loosing his job was not my partners choice, being ill is not mine. Had Capital One acknowledged this earlier I believe the interest and late payment fee's they included on our account would be tiny, therefore the total owed less and moreover less stressful for us to find in the long term.
I only asked for a bit of advice from the helpful people on this site, the next time I need your 'not so helpful' input I'll remember to ask you, otherwise bogg off.0 -

Well said!! BounceBackAbility, give aquarian3 some respect. You're probably far from perfect yourself, especially with an attitude like that. Sure, think it, but don't insult someone who honestly looks like (s)he is trying to sort their situation out as best they can and just wants to vent their frustration.
