This morning we have received a Notice of Default from Capital One. We are more than six years into our DMP. Am thinking this might be the time to CCA them. Would appreciate a bit of advice here.

i have started to cca all my creditors and im getting lots of mixed replies, some are not enforceable, some appear but im taking further advice, and some im complaing to fos as they are not clear and legible,
so if you start cca all, be prepared to be organised,
any help pls shout, check out any of the cca threads already and good luck

Sorry you're struggling. You will need to do another review. Don't feel guilty - if your circumstances have changed and you have to add another debt you didn't know about, then it's not your fault!
When you had no job, you should really have rung CCCS for advice to reduce the DMP till you found something. Mortgage and council tax are priority debts that should be paid before all your other debts - even CCCS say that
So I suggest you ring them. Tell them about the scottish power debt (if you can get it confirmed that you do owe them - I can't see how either but some older meters apparently they don't update quickly enough when the price rises so debt appears) - they should easily be able to add that debt to your DMP, which would be one less worry.
Then you need to tell them about the reduction in maintenance payments coming in. And the increase in CSA going out. The CSA is another priority debt so they have to make allowances for that. (I know they are a pain in the bum though with the amount of time they take to work any figures out :rolleyes:)
The point of a DMP is to be able to LIVE, EAT etc while paying back your debts.
It may be that some other avenue would be more appropriate to you than a DMP? Not sure if you have taken advice re: bankruptcy etc?
Also, when you start a DMP it does take a few months before any debts start to fall. Where they added interest while I was making reduced payments, well I just added this as part of my debt - I'd have had that added on without the DMP anyway. When they stopped interest after about 4 months, I took that figure as my start point (as that's when they had all agreed) and started to track the figure as it reduced from then on.
Chin up, at least you are trying to deal with your debts. But CCCS can't give you full advice and help you if you don't let them know what's going on.

Thank you Newlywed, you're right, things cant continue as they are so I will get all the new bits and pieces together and give CCCS a call. Thanks for the reassurance you've given. I suppose once you actually start your payments on a DMP you believe that things will instantly get better and stay better ... we forget that there are other events that will come along and challenge you even more.
I'm guessing that because we're now with BG for both gas and elec that SP cant cut us off for an outstanding debt (assuming of course that it is a valid amount outstanding) so perhaps we could include that in our plan if needs be.
Oh for a quiet life eh? Wouldn't we all love to have one of those? Anyone know of a BOGOF offer on them at the moment?Hubby could do with one too

I know what you mean about thinking starting the DMP will mean things are instantly better, but sometimes things in life come and bite you on the bum when you're not expecting it
CCCS are there to help you. They are really nice when you're in trouble and ask for their advice - even if you sob down the phone like I did when I didn't have car tax and MOT money and that would have meant I couldn't get to work
But they can't help you and give advice if you don't tell them about it

Minor progress report on my DMP proceedings!
Some (not all) of my credito's have accepted my plan :j
Trouble is CCCS reviewed me in between times and we decided I should have a bigger shopping budget! Now I am waiting to see if the credito's (I am spaghetti westerning them today!) accept this or already have
I have had no further calls though which is pretty cool and I chanced calling a couple of them up just to discuss and all were pretty good about it all.
All in all mustn't grumble!

Havent been on for a while, just been sooo busy...
Anyway, did anyine see panarama last week???
What do we think?...Is it poss to get any of our debts written off???
Im always interested hoqw to reduce my debt, i just have no idea what sort of loopholes im looking for, Do i start with asking all my creditors for signed copies of my agreement?

I think you'll find there's a mixed opinion on getting debts written off. Personally, I want to repay all my debt as I incurred it. I would like my charges back however and will use the CCA as a way of trying to get charges back and interest stopped for the purposes of my DMP.
I did see the Panarama I think. I saw the one bloke who had mega amounts of debt and was complaining about Natwest going for an order for sale or something. The copy of the signed agreement you mentioned. If you search for CCA you'll find a lot of discusions/debates about requesting Signed CCA's.
