Credit Card Protection on eBay

I've made a seller on eBay a personal offer for an item and they have asked if I can send them the money direct through PayPal without going through eBay (so they can save on the eBay fees)

I know eBay don't like people doing this because they miss out on the fees, but what I wanted to know is if I make the payment through PayPal with my credit card and something went wrong, could I get the credit card company to reverse the transaction (chargeback)?

I know you are covered if you buy something from a merchant and they don't send you the goods, but does the same apply for a sale with a private individual?

    I had a similar senario some weeks ago with my First Direct Visa. They confirmed that they would not assist with a chargeback as the transaction was routed through a third party (paypal). The first redress they told me, was via paypal. Contact your card company by email (to get in writing) for a response.

    On the moral side my view is that ebay have helped you locate this item so they should get their fees.
    If you found an item via auto-trader (or other method) do you think it's fair they don't get paid?

    I believe you will still have the standard paypal and credit card protection.

    Note that credit card protection starts at £100.
    I think the person in post #2 has been a little fobbed off.
    It may be correct to start with paypal but the credit card company is still liable and you still have your statutory rights (above £100) but they will of course try to persuade you to go down a different route.

    You will of course lose all the facilities of ebay.
    I suspect you have checked the seller feedback rating so on a moral level it seems you want to use ebays facilities but not pay.
    Surely you can see that isn't right.

    I have to say i'm going through a situation for £347 for item not received from australia, i used my credit card and lloyds finally sent a letter saying not covered under the consumer credit act as they fulfilled thier obligation by processing the payment to paypal.

    going to Financial ombudsmen now to see waht thier final response is, but now i would never use my credit card thinking i'm covered!

    At least paypal are now being up front with the situation from what other posters have said.

    The process as I understand it is

    Your Credit Card is processed by paypal to buy "paypal £'s" this transaction goes smoothly and is the end of your card companies involvement.

    Paypal use these paypal £'s to pay the other person and then at the other end these can be transferred to a bank account or credit card by the seller.

    As far as your CC company is concerned they have done what was asked and transferred moey to paypal. Their dealings are with them.

    Any further disputes have to go through paypal.

    Paypal isn't that safe really, not as much as they make out anyway.

    Personally I use it on ebay for buying and selling and have not had any issues.

  • I think if you used your cc to pay a merchant, it's done as part of a business transaction so would be covered by the Consumer Credit Act 1974. However, if you paid someone personally via PayPal bypassing eBay, it would be classified as a personal transaction, so would not be covered by the CCA 1974. Your recourse, if things go wrong, would be to take that person to court to claim back costs.

    I see where Lisyloo is coming from regarding the "moral side", but I have bypassed eBay sometimes, by making direct offers to the seller and paying by PayPal. Before anyone says "boo", these items were hatching eggs from poultry breeders and the purchases were not for items as listed but to my own specifications; I merely treated eBay's listings as advertisements i.e an "invitation to treat". For example, a seller would list 6 Sussex eggs at a starting bid of 0.99p, I would e-mail the seller and offer to buy 12 for £1 each plus p&p. If the seller was agreeable, we would conclude the transaction off eBay and via PayPal. I must say touch wood I've never had any problems with this arrangement.
  • Well, for those of you that have not been helped by their credit card companies in Paypal disputes, the answer is pretty simple. Vote with your feet! If they can't be bothered to help you, they can get stuffed.

    I use an Abbey Credit Vard and a Barclaycard. They have both been good to me, and both have recovered money from those scum bags at Paypal on more than one occasion, Abbey being particularly good.
  • P.S, your credit card comapny is 'jointly liable' with Paypal in this. They have no right to fob you off. Launch a small cliam against them. Believe me, they will pay up to make it go away....
