surely if the customer makes the offer at the time of paying, the offer that the customer has made is the amount shown by the store on the SEL or other price displayed by the item.

So if the store charges a different higher price (and we can't possibly check the prices as they go through if you have a large shop, as you are too busy packing) then they are at fault, because you offered a lower price and they did not say no, its actually a bit more.

To reiterate. A price displayed on an item in a shop is an indication of the price that the shopkeeper values the item at. The item on sale is not an offer at that price, rather, it is an invitation for you to make an offer. You take the goods to the till and your offer is accepted or not by the shopkeeper. The shopkeeper does not have to accept your offer, and indeed, might and can refuse to sell you the item.

However, it is an offence that is covered by trading standards who can fine retailers who persistently display incorrect prices. Some sort of mis-description / mis-adertising regulations apply.
This is the reason that many of the big supermarkets have such policies, as it keeps TS off their back. iirc tesco's R&R policy was in direct response to TS action, to prevent a huge fine.

Yes, the legislation you are referring to is The Price Marking Order 2004. The Consumer Protection Act 1987 also refers to misrepresentation. See here:

bindiboo - take along a print of the asda website where it states the giftcard policy in black and white:

    http://www.asda.co.uk/corp/customer_service/FAQs.htm

Hi, If you look on the website now, I don't think that it is on about the giftcard, I've looked and can't find it.
I wrote a complaint to Asda's CS dept last week about being overcharged, I mentioned the £2 gift voucher but was told that it was at the store's discretion as to whether they give it or not. I didn't get offered any.

It does make mention of the giftcard, it's the last item on the page:

What happens if I am overcharged?
If you have been overcharged in any of our stores we will gladly refund the difference (if you have been overcharged) and give you a £2 Gift card voucher for each product you have been mischarged for.

Yes.I saw it on the link that was posted, but have looked on the website for it and it doesn't seem to be there now, thought it was perhaps a link to an old site.

I was going to reply to their reply to me and quote the policy on it, but couldn't find it when I looked.

These are the only FAQ I can find on there now http://www.about-asda.co.uk/faq/

I will write to them again though, quoting the link printed here, see what they say. They said in their last reply that it was at store's discetion.
