    OK so I have now got the dress back and there is no loose stiching and it just seems strecthed due to a tight for person being too big for the dress....and there is now also a deodrant or gel stain on the dress, quite noticeable...this was not there before.....

    So what do I say to the seller as shes going to start Item not as decribed as if she does not get her money by monday...so she says....also where do i stand with all this am i supposed to just roll back accept the damaged dress and give her the money back.....can I not start...a dispute of some sort my self......

    Dates? Best-case scenario for yourself would be to string it out beyond the 45 day limit and then, to be fair, return the dress to her.

    EDIT: ISTR when I last looked into distance selling that BiN was a key element when establishing whether DSR applied or not, auctions not being covered.

    Did she send it back by trackable means? If not that’s the end of your problems

    Otherwise you could defend her dispute on the grounds she’s damaged and stained the dress by being too fat and with sweaty armpits (but maybe phrase it a bit better)

    Hi guys thanks for the replies, yes she sent it recorded and has asked for a refund twice since sent it....I am really fed up with this transaction...and not sure if I can be bothered to go through a dispute and for paypal to hold on to my money for a month whilst they decide to award the buyer ....i can still sell the item howevevr not as brand new.....dont know what to do

    Wonder if it is the same person as Soolin had trouble with? Surely if it has been worn with sweat stains then that voids the transaction. The same as it used to be with Catalogues (Grattansetc) and M & S.
  • It definitely sounds as if the item has been worn.

    A Buyer I had a problem with back in March said that a brand new with tags jacket had loose beads and fraying - I knew it did not.

    I refunded her on return and as I already knew the jacket was perfect

    Yes she tried it on and the stain must have occurred when she put it on or took it off, its not major but it can be seen, the left side of the dress is stretched. The tag is still on and the dress is really not damaged, I can resell it however not for the same price as I now have to highlight the stain and stretch, as such can i be bothered to go through the whole paypal issue which will take at leat 6 weeks and nothing might come out of it.

    If they were going to hold my money and give me intrest for holding my money for so long, I would not mind, however they will hold my money for 4 - 6 weeks no interest and will poss still find for the buyer at end of the day....am fed up:confused:

    As far as I can gather, the Buyer will win a paypal dispute regardless since it seems that is the way that it works.

    Which is great for Buyers but not for Sellers

    hmm so basically just refund the buyer......:mad:

    can i not start a dispute or is it only buyers that can start a dispute......
