Removal of entry on credit reference

Hi, :j

Any advice greatly appreciated, my husband is paying instalments to clear a credit card which went into default. The 6 years will be up in July 2008 but the balance is not clear. Can the company re-enter this information and it stays on for another 6 years or does it come off his file.:confused:

    It should come off his Credit Reference Files 6 years from the original default date.

    The company are not entitled to register another default.

    Is that even if the debt hasn't been fully paid within the 6 years but all standing order payments are up to date and go out each and every month.

    Can the agency still re-enter the details and keep it on another 6 years.

    Did hear that if they hadn't had contact with the person who owes the debt for a certain amount of time that they cannot pursue the debt does anyone know whether this is right? I have been dealing with the agency not my husband whose account it is.

    The company who are a pain is Allied Credit based in Scotland. The other two creditors do not contact me as payments are also being made.

    The male staff that I have spoke to are very aggressive and threatening.

    I will not even speak to them now. But would like to know the law if anyone can help.

    Yes. Even if it hasn't been paid in full.

    If you haven't heard from a company or have not written to or made any acknowledgment or payment within a six year period five years in Scotland the debt is Statute Barred.

    If you go across to thhe debt-free forum. They will assist you further. HTH

    Arh no I have spoke to the company today and have spoken before on the telephone and they have written addressing letters to my husband but my husband hasn't spoken to them and it is his debt.

    I am paying it off for him through my account and I appreciate that it has to be paid which it is in instalments the real worry is that they could re-enter this entry if not fully paid

    Have I got this right if it is not paid in full within the 6 years they can re-enter the details for another 6 years.

    I shall just keeping sending my payments to them and eventually this account will be paid off.

    Allied International (sorry not Credit) based in Scotland are very aggressive at least I know where I stand.

    They will advise you on any help.
