Some DCA's have tried and suceeded to bankrupt a debtor but in reality it is rare mostly due to the fact it costs them a small fortune and they have no guarantee of getting it back.

Do you (or anyone else know how much it cost a DCA then?) would the Judge in the case go for the side of the debtor if he/she has shown willingness to come to a payment arrangement?

Would a Credit card company / DCA only do this for a very large debt?

I think it's around the £1500 mark. A DCA might do it if they smell money such as equity in property

Judges can favour on the side of the debtor especially if they see you have a payment plan in place and you are reasonably attempting to pay the debt off.

    Thanks all!!

Don't let the b******s get us down eh!!

Just for the record I guess we've all had to deal with DCA's here? But I was wondering who had ever been taken to court by a DCA for not paying a debt off in full? I ask because all DCA's thraeten Court action but how often do they go through with it?

I've not had experience yet with DCA's as my debts are all still with the original creditors but from what I've read on here, it seems that the DCA's are very likely to take you to court, seems quite common. That's probably not what you want to hear!

Like I said, if a judge can see that you are trying to pay your debt off then they may favour on your side.
