Advice with Capital One debt...... Please!

Hi All.

Can anyone offer some info / advice please.

I got into trouble with my Capital One credit card about a year ago (couldn't afford minimum payment etc etc) and they agreed to a £40 per month payment plan with interest and charges frozen.

Out of the blue last week I received a default notice!

I telephoned them and they said my account is now being passed onto a debt collector and they were no longer offering me a payment plan.

Does anyone here know what debt collectors Capital One pass there debts onto? Any experiences regarding Capital One would be great to hear.

Also, as a general rule, how long do credit card companies let you have a payment plan before they pass onto a debt collection agency? Is it 6 months, 12 months? Or will they keep renewing the Payment Plan as long as you keep up the payments?

Once again any advice on this would be greatfully received and appreciated.

    All companies have different policies. You just have to wait till you hear from the DCA now . There are do,s and don,t do,s now . Main one is never ever ring them , it does absolutely no good . All they want to do is force you to agree a payment over the phone . Never give them a payment over the phone , it has been know for a DCA to take out more than you agree to . Conduct everything by letter only . As soon as you get there letter , put in a CCA REQUEST AND A NOTICE OF ASSIGNMENT .
  • Hi there, I can't actually give any advice on this but was wondering how you managed to get them to stop the interest and charges? I have written to them numerous times explaining my financial situation, I sent copy of wage slip and bank statement as they had requested, a copy of my income and expenditure. They keep phoning me both at home and at work though I have written to them about this and sent it recorded delivery. At present I am paying them £35 a month which is the most that I can afford but because they keep on slapping the interest and charges it makes no difference and my debt keeps increasing :mad:

    Capital One have their own internal debt collectors trading under the name of 'Debitas' and there is a thread on here of how one person dealt with them. (you need to read it all for full effect).

    Don't let them get you down, they will be offensive and use bullying tactics to get you to pay up and create as much stress as they can until they get paid.
  • yes going back when i was in debt , there is light at the end of the tunnell i think is was robinson way or something if you cant pay dont its that simple change your phone number if you havr to pay what you can afford only

    Didn't they try to take you to Court though?

    What debt did you have with them (if you don't mind me asking!) mine is around £2500 if that is of any help?

    I have debt with Capital One & can only afford token payments at the moment (about £1800). Informed them at the beginning of the year with relevant inc/expend/letter (same as sent to everyone else) and they rang me frequently saying that wasn't good enough they wanted a higher payment plan. Its nearly 6 months later, & whenever they ring they ask for info they already have and I let them know theres no change and to be honest they just don't seem to listen. When i was ill a few weeks ago they called me 3 times a day, on both home (& mobile when i didn't answer!) and this went on for 2 weeks! I did speak to them initially and it was the same old and they told me it was going to be defaulted, bring it on I say, they can't be any more useless than C1 at listening!! After a couple of pointless conversations I just put the number onto my reject list :rolleyes:

    Not sure whats going to happen now so will follow this one with interest, good luck to us both!

    Oh yes and in relation to to the MBNA thread I've actually found them to be fine, frozen interest & fees immediately even though its my biggest debt, in fact last week i was offered a settlement figure of £1850 on a £6200 debt! was gobsmacked, just wish i could have won the lottery last weekend & sorted it! Ah well life goes on.

    I need some advice, i got into difficulty with my Capital One card and have had some default notices added (due to me being unwell and unable to work) and my debt has been passed to Debitas. I recieved a letter from them asking me to pay the full amount which i am unable to do and i told the guy this and explained why i had got into difficulty in the first place. He seemed understanding and said that he would send me a income and expenditure form and that i could pay about £20.00 per month to clear the debt. He also said that due to the circumstances he maybe able to get the defaults lifted. He said the form would be with me in 5-7 days, within this time i recieved another letter from another Debt Collection Agency saying the debt had been passed to them by Debitas as i failed to make payments!!!! I called up Debitas and told them about the letter and they said to ignore it and the form was on its way so that i can start making payments. No form has arrived still - its been 2 weeks and i have has approximatly 8 phone calls per day on my mobile, god knows how many at home (i am now back to work) and i get at least 4 in the evening from 5.00 until 9.00pm! i have answered these calls but no one answers. I did call back the 0800 number that called my mobile and the person who answered was obviously in the middle of a conversation with his colleague as he answered laughing and told me to hang on! I said that i wanted to speak to someone else and he said no so i hung up!

    I have now got a letter from Debitas telling me that they are planning to take immediate action against me as i have FAILED to keep to my plan (what plan!!) it also states that they will pass to an external debt collection agency and that i have one last opportunity to repay the debt and to call them with my OFFER???

    The ending statement on the letter is 'THIS IS YOUR FINAL OPPORTUNITY. FILURE TO TAKE ACTION MAY HAVE SERIOUS CONSEQUENCES'

    Too be honest i am scared and frightened and feel toatlly harrassed by them, i have complied with them and its not my fault they have not with me and now they are threatening me.

    The letter arrived yesterday and was dated the 15th.

    I need advice as to what to do before i call them

    I have not had my account passed onto anyone yet as the default notice was only served last week. If anyone could help the person above with any info that would be good.

    DOES A CREDIT CARD COMPANY OR DCA EVER ACTUALLY ATTEMPT TO BANKRUPT SOMEONE OR IS IT ONE OF THEIR THREATENING TACTICS?

    Some DCA's have tried and suceeded to bankrupt a debtor but in reality it is rare mostly due to the fact it costs them a small fortune and they have no guarantee of getting it back.
