offer accepted on house then another offer accepted without me knowing.is this legal

    But had I known I wouldnt of accepted an offer on mine, as now I will have to let them down.
    The estate agents have lied and not had mine nor thier clients best interests at heart.

    Well, firstly you don't have a buyer yet.

    But even if you did, you wouldn't have to let them down.
    You can sell and buy a different property at some future point.
    Then you can go off to do your studying.

    As the purpose, it seemed to me, was to be able to go full-time studying, then all you need to do to achieve that is to sell your house.

    You don't pay them - they have no obligation to you.

    They DO have their client's best interests at heart if their client is progressing with somebody who is in a position to purchase the property.

    I agree with Doozergirl it sounds as if the estate agent just over-estimated your understanding of house-buying and selling and didn't explain the situation as thoroughly as you could have done with.

    If they advised you not to proceed any further without an offer, I imagine it was precisely because the property was still on the market and the vendors would still accept an offer from someone procedable rather than yours. The advice not to instruct solicitors, get surveys etc, was to prevent you spending money on a purchase that had a high risk of falling through.

    For future reference, when you have an offer accepted you should recieve a lettter from the estate agent, setting out in writing what the agreed price is, and any basic conditions - for instance it will probably say that you will instruct solicitors forthwith, and the estate agent will chase you until you do so!

    Just to add, you now say you've accepted an offer on yours, but in the first post say you're expecting an offer on Friday? If it's the same people, and they haven't actually made the offer yet, you're not letting anyone down.

    Did you receive any confirmation from the EA with regards to your offer? If so what did it say?

    From what you have posted, I do not believe the EA has lied to you, a break down in communication or a misunderstanding between you &the EA, yes, lies, no. They have their clients interest at heart, they have found them a proceedable buyer.

    Would you accept an offer from somebody who did not have their own property on the market?

    I have spoken to my estate agent in light of all this misunderstanding to clarify the position of my buyers, and they are offering on friday, just want to clarify figures first. they have large portion of money available though. They would of put an offer straight in but knowing my position, wanted to wait until seeing the financial advisor first.
    I cant just sell and go onto further education and everything will be rosey, as I will be homeless with 3 children for a start so that will have to take priority, and wothout being able to sell and buy outright, I will have to continue working full time to support us and pay the mortgage.

    Just to confuse the issue even more, a friend has just rang and sked to view the property and is seeing it saturday with a view to putting an offer in. Told the agent she has hers on the market but no buyer and is still allowed to see it
    Seems all wrong to me!

    Now you know why people really couldn't care less if EA's are being made redundant due to the credit crunch!

    Too many sharp, unethical practices. They deserve all they get IMHO.

    I appreciate they have to make money etc, but why accept more viewings, also told my friend the offer they have in is just below asking price. I am going to get her to offer 2 grand over and see if they accept. Then we'l see what happens!

    Are you winding us up? What are you trying to acheive here?

    I don't understand why you are quite so sure of what is right and wrong when you haven't done this before. And then on the other hand you're quite happy playing silly beggars with the EA to catch them out. If this house is available then you won't be making friends down there and you are going to scupper your chances completely.

    Leave it right now. When the offer comes in for your house and you have accepted it, lets go at the house full throttle if that's what you want and we would try to help, but at the moment you are not in a strong position at all and you have to accept that. Stop playing games because you are being incredibly childish about this.

    If the property is still being marketed then you may still be able to buy the property but you need a proccedable offer quick sharp. Ideally that offer comes with a mortgage Agreement in Principle which means that your buyer is proceedable as well.

    If this house is undervalued then it will attract interest. It's possible that they will ask for sealed bids if they are still allowing people to view. You can view without having sold, although if the property were truly under offer then they probably wouldn't accept viewings.

    And as for being homeless, there are more than 2 houses in the world. Look at other properties this week. You could even rent and use the interest on your savings to pay the rent until a suitable property comes up. If you want something badly, you have to take the risks to get it, especially if it will improve your life.
