Can they build a garage off the boundary wall

This is my first thread, so i hope i do everything ok. Help and advice would be great, after asking my neightbour at the weekend what his intentions were after taking down the fence he informed me he he is going to build a wall then a garage off the boundary wall, i asked about planning he he said as long as it was ok with me then that was ok!(he mentioned the height he could go to) my question is after ringing up the council i am still waiting for the booklet i know that it must be under 4m if a ridged roof, but can he only build the wall to 2m as it is a boundary. I am also concerned about the guttering being on my land. This garage will also take the sun from my garden in the afternoon. I want to be tactful but know what i am talking about, as i know i have to express my concerns and soon!

  • He can't do that.Just the guttering being over the boundary line is enough to get it stopped without all the other issues.Get in touch with the local planning office and tell them your concerns,they are duty bound to follow up complaints.In the meantime all the info you need is at the planning portal.Just type it into google.

    he cant do that at all and if he does you can get him to take it donw legally, he only doesnt have to have planning prmission to build something of a certain height if it so so many metres away from the houses, not sure of exact length but google it

    Thank you so much for the information, I have looked at the planning portal and again it says the boundary wall can only go to 2m, so i guess if he wants to build it then he will have to go back on to his land to get the guttering in and a max of 2m for the outside wall. thanks again

    He may also need to use 'the party wall act' if he is building within 6 metres of your property or is planning to have foundations projecting under your land. I suggest you Google 'party wall' issues. A garage if under a certain size does not need building regulations - so please don't rely on that being bought into play.

    Thank you, i have just looked at that and I feel he should have done this before as he has already taken the fence down then dug out all the boundary greenage so i am looking straight in to his garden, he has been measuring out tonight and putting down rubble and there is a trench dug, oh happy days

    I'm stunned a neighbour would go ahead and just do this, and wait for you to ask what he's up to! I knocked down a ramshackle outhouse that was on my property, and then put up new fences. I let my neighbours know what I was planning before I started just out of courtesy - after all they were going to have to put up with all the noise for a week.

  • You don't have to if you are worried about it.Ring,or better still,visit the planning office and voice your concerns.They will sort it for you.
