    They are taking the mickey completely. I cannot believe what i am reading.

    They are now squatting in your house.

    I would get reading sharpish on removing people from your house when no rental agreement or AST is involved.

    You have paid them, you own the house, you need to take possesion of it fully get locks changed and if anything does happen to the house in retaliation the police will know where to go.

    They are at work right now. The Seller left me a voicemail message asking to speak to me to negotiate rent and what to do. It is a bit late for them to be negotiating right now, as we Exchanged Contracts 2 weeks ago.

    My Solicitor has faxed a legal claim to their Solicitor, and advised me to keep hold of all hotel receipts, etc. I am living with parents right now though, but my Solicitor is going to put in a claim for every day that they squat in the house. The claim will include Interest on the Mortgage monies +4%, inconvenience and other expenses that I incur as a result of this.

    My Solicitor is prompt with things and already on the case about suing them. Anyone know if it is possible to completely withdraw from the Purchase?

    You cannot wait for them to get home - you need to get a locksmith out and change those locks.

    They should be out already. Who works on the day their house sale goes through and they have to move?

    This is worse than the idiot who bought my friend's flat this week. Completion was monday - on thursday last week contracts still hadn't exchanged. my friend threatened to pull out of the sale and contracts exchanged at 11.30. Then the buyer rang to ask if it was okay for him to move in at 1pm!!!!!!

    My friend hadn't packed as the sale could have fallen through, and stuck to Monday. She moved out on the weekend, and the buyer texted her on Saturday evening to ask if he could move in yet.

    She said 'when you've paid you can have the keys'.

    Your buyers have no right to access the house anymore - you need to go and take possession NOW.

    Doesn't the EA have keys?

    Spoke to the Solicitor who have faxed the Breach of Contract document to the Sellers Solicitor.

    The Sellers came round to my house and asked to negotiate, but I refused. Cut a long story short, they have agreed to move out over the weekend and give me the keys on Sunday evening (3 days late). They are scared of the excess charges that my Solicitor will send through, so created a written paper stating that I am happy for them to stay until Sunday evening and I signed it - as they applied a bit of pressure (in a subtle manner - with indirect threat). The letter also states that I do not want them to be charged any more for Breach of Contract.

    Is this a legal-binding contract? I am happy for them to stay until Sunday evening, providing they vacate by then - which they have finally agreed (i hope).

    I believe that my Solicitor faxed the letter to their Solicitor about 1pm, but I signed it at 5.30pm. Therefore, I guess they are liable for cost involved writing the letter, but any further costs, we can resolve - putting things on hold?

    (Apologies for the big mess around this. I knew that this Purchase wasn't going to be easy).

    I find this story mind boggling! :huh:

    Let me understand -
    you are the buyer
    you completed & paid the sellers the money, not a surprise to any party
    they have breached the contract by not vacating the house
    your solicitor issues them with a warning and claim letter to protect you

    Yet, you have been bullied! by them!! to allow them to live free!!! in YOUR HOUSE for 4 days? and you've signed a letter waiving your rights without consulting your solicitor.

    I am sorry, but this proves some people really shouldn't own a house :confused:

    You really shouldn't be apologising, not here not to anyone. You need to grow some balls!

    What a nightmare! I really feel for you and I can understand why you ended up signing the paper. It probably isn't legally binding but won't help your case for compensation etc. However, you own the property, they are trespassing by being there no matter what their threats. If they try to contact you again I would inform them that they are to contact you only via your solicitor from now on.

    I suggest that if they haven't given vacant possession by the deadline you get your solicitor to go ahead with suing them for the costs and compensation etc. The minute they are out I suggest you change all the locks fast! Dynalock were good when I needed locks changed in a hurry to keep a violent ex out (that's another fun story! lol)
