IB Tribunal (written)

Hi all

Does anyone have any experience on written tribunals (and hopefully good outcomes)?

We have appealed to the point of tribunal, CAB dont wanna know and OH (his claim) is not comfortable/happy/upto the oral hearing which we believe would actually be better :(

  • It is true to say that oral hearings are overall far more successful,and from what people have told me they aren`t as stressful as they`d imagined they would be.
    If and now only if,you qualify for legal aid then http://www.clsdirect.org.uk/
    maybe able to find you help in your area

    My husband had a written appeal and won.

    But he did have back up from people who deal with him medically.

    We would have to had done something like 100 + mile round trip and then the stress of not knowing where the building, was finding somewhere to park, me taking unpaid time off of work etc.

    Can't help you much apart from saying getting as much information as you and give yourself plenty of time gather the evidence.

    I just hope that what I have written is good enough. We do have a letter of support from the GP too.

    We have no idea when it will be though so we just need to watch this space :D

    In our experience, tribunals are normally just you and one other person (maybe that's because we're so rural and can't get anyone to come out to us). Hopefully someone will be able to confirm this. Your OH would just need to go in and say his bit and that's it really - not as daunting as he may think.

    Sorry Tigtag it was DLA written appeal for my husband I just realised that yours is IB. But suspect the same sort of thing is needed.

    Just lots of supporting evidence. Is the reason your OH can't go bound up in his condition. You don't have to tell us what it is. But wondered if that could be used to support the written claim.

    Its his pride thats stopping him going and the fact he cant speak about what a failure he feels (and made to feel more by the system) without breaking down.
    He's emasculated enough at the mo without the water works to boot (if that makes any sense at all)

    Bit of a poor show that the CAB aren't helpful....not really backing up the ethis of what they are for eh?!

    I wasnt saying that you would,however cls used to give advice and point you in the direction of help regardless,now they can only do so IF you fall into legal aid category
