Third Party Fire Theft Insurance - Hit And Run - Can I claim?

Hi,

I have only TPFT insurance and was involved in a hit and run when my car was stationary which caused about 1k worth of damage

The question I have is can I claim and is this classed as a theft?

    Fraid not. You need compehensive insurance to be able to claim for damage to your own car.

    TPFT covers you for any damage you do to others, fire damage and theft. Nothing else.

    You could argue that the proximate cause of the damage was theft, assuming the car who hit you had been stolen...
  • At best there would be footage of this which you could involve the police with. If they can trace down who did it then you can claim off there insurance / MIB if the person isn't insured. If the car which hit you was stolen then I believe you can even claim off the person who owned the car before it was stolen...

    If there's no camera's set up, no witnesses, no trace of the driver then since you're not fully comp you won't be able to claim off your insurers and will have to foot the bill yourself - assuming it's not superficial damage to the car which you could maybe live with...

    No you can't. I have been in that situation. If the car is stolen, the owner's insurance has no liability for any 3rd party damage caused. Your only recourse is MIB

    To the OP - you cannot claim for this under your policy. The theft section of your policy covers loss or damage arising from the theft or attempted theft of your vehicle.

    This is not wholly correct. If the driver of the stolen car is identified then the insurer of the car which was stolen does incur RTA (Road Traffic Act) liability for property damage and death/injury (s.152 of the Act). Only if the driver is unidentified does the claim fall to be dealt with by the MIB under the Untraced Drivers Agreement.

    You can only claim for property damage under the Untraced Drivers Agreement if the incident is reported to police within 5 days, the vehicle that caused the damage is identified, and there is no insurance to cover the damage.
