Car Accident/Insurance help..dont know what to do!

Hi everyone,

Last december my OH was in a minor collison in our car, a fiesta. The people who bumped into him fromt he side were absolutely awful to him. They were threatening to beat him up, sweaing at him and all sorts of other things.

Anyway I then spoke to the delightful lady that evening and she now said she had decided not to claim because there was no damage, which we knew. There was a very small dent in our car but we didn't think it was worth claiming really.

Then we realised she had actually ocntacted her insurance before I had spoken to her and so the whole claim process started up. Luckily, we had the name and number of a witness and she wrote a full statement for us to say it was their fault. She has submitted this to our insurance and they have sent it on to the ladies insurance (which sounds like a small independent comp).

This has all taken 6 months and still not sorted because we can't get a response from their insurance. In the mean time, they have put my premium up by £30 a month and taken away our 3 yrs no claims until liability is sorted out.

The problem is we want to get a new car which we had planned for around about now. Because of the fact they have taken away our no claims, the insurance will cost us £1400 a year. If we had our 3 yrs, it would only be £78 extra for the year. They said if liability is admitted by them, they will reimburse us eventually but I dont hold out much hope of them responding to our insurance sending letters etc.

So what would you do? Hold off on getting the new car? Should I call the lady again and see what is happening?? Even though she is quite scarey!

So frustrating, we had looked forward to this new car :(

    I'd wait.

    Rule 1 in life: Never speak to scarey women.

    Anyway, the scarey woman won't know what's going on most likely. If it's in the hands of the insurers you just have to wait.

    How the hell can they suspend 3 years no claims? I thought it was normal to lose the highest single years no claims for a first accident ,ie, normally the first one you earn 30%??

    2 things, badger your insurers on this and the fact that things are taking so long.

    Don't try to address it through the other party, you'd be wasting your time and causing undo stress to yourself.

    Have the self belief to go ahead and replace your car, don't let some idiots actions affect your lifeplan.

    If it’s clear who’s fault it is and you have a witness then I’d be tempted to get a quote for the repair to your car, fire off a letter to the other party saying pay up or small claims and, if they don’t pay then invest £40 in a small claim.
