I would think the percentage of transactions that are subject to a Section 75 claim is relatively small.
Also they do not necessarily have to write the debt off - they may be able to make a chargeback, or claim the funds from the receiver in the case of the supplier going bankrupt.
I agree that this protection should be made clearer to the customers, I am sure there are many cases where no claim has been made simply because the customer was unaware of the protection that they had.
Nick........ The % may be small but, if you are one of the 'claimants' then it is of great importance to know about Section 75. In my case several thousands of £££ were involved.
Also, the car company did not have any funds for the card company to make a claim against.

I am pleased to announce that my claim against the CARD company has been successful - it was a long, arduous road but my advice is to persevere.
The Card Co. was non too helpful at first and appeared to put obstacles at every turn (even 'losing' copies of bank statements on their own premises !!), however, my terrier like instincts did not let go of the sight of my goal - to invoke what is the law of the land. (section 75, Consumer Credit Act, 1974 )
TIP: Make copious notes and keep copies of EVERYTHING (emails, telephone calls, all correspondences) and use recorded 'signed for' mail.

I agree with you, I have also benefited from Section 75, although not for as larger transaction that you had a problem with.
To be honest in my own case, the Card Company were very helpful and immediately initiated a chargeback, but I suspect the size of your particular transaction caused them to hesitate somewhat.

Also really good information for others. I guess the moral is to always pay deposits by credit card for larger purchases as this legislation obviously gives you greater security - even if you do have to fight for it!!0 -
