Querie about CC Statements

Hi, I keep getting my CC statements with CapitalOne either on or a day either side of the due date, giving me no chance to make a payment... Then If I do make a payment I get stung £20 for Late Payment & sometimes non payment of £20
I speak to their Cus. Serv. Dept & they basically tel me tough as they send out the statements of the 3rd of every month... Blaming the postal service!!!
Well, today my Statement turned up for August!!! Septembers Turned up as well... oh & my Due Date is 28th of every month...
Anything Legally I can do? as Capital One say a statement is just that & they dont really need to provide them...... I cant talk to Capital One anymore as I end up just hurling a load of abuse at them!

Of course, this is wrong. I dont have an online account with them & Dont want one either.
Direct Debits are a no no for me. My money management has been useless in the past (mainly messed up by DD - Quite often companies have say taken out £200 instead of £20, quite often its put me overdrawn & then I get bank charges) & apart from that, I dont have a Set Pay Date - it can & has varied by as much as 2 weeks!!!! I did do a standing order of X amount a week, but sometimes if that fails to reach the minimum then I get stung for late/non payment charges & just wasted money...
So basically, what I do is save up all my statements throughout the month (phone, mobile, internet, etc.) & then pay them all on Payday... But im always missing the Cap One Statement or have one for the previous month
Their Cus Serv cant grasp the Idea Im receiving my statements late & thats why I have been refusing to Pay (this has been going on since July)
I have other money problems which Im sorting one by one, Capital One is the next on my list as im trying to pay off the smaller ones 1st...
Was thinking of writing to them & offering them a settlement figure, but Ive been told Cap One dont accept them0
