Please Help

Hi in june last year i had a claim with direct line onw hich they majorly undervalued my car and then paid me twice to which i didnt tell them because i was so angry they had undervalued my car but today they have told me they want there money back and i aint got it can anyone help

    Hi ... not making any judgement, ok?

    The potential consequences of knowingly taking the payment twice could be very serious, and without asking nor indeed wanting to ask for any details of the background or the current tone of the Insurer's request - my advice would be to see a solicitor - firstly to make sure your interests are best protected at all times, and to negotiate on your behalf about paying the money back.

    exactaly what i thought, im sure i read somewhere there is only so long they have to claim it back before it is legally mine tho is this just jiberish?

    I don't think you want to find out the hard way, huh? I'll stick with the advice i've given.


    PS: to avoid possible confusion _ i would suggest deleting your post in "The Arms" - asking the same question - up to you - but two threads causes confusion, imho.

    well i didnt at the time realise because i asked for them to cancel the cheque and do a bank transfer instead but they did both i realised about a month later. It aint about finding out the hard way its a case of i dont know the answers to the questions hence why im asking them sorry if i have offended you in any way

    They are quite within their rights to ask for it back and the law supports that stance.

    However, you can ask for and expect to be given 12 months to pay it back (i.e. monthly payments).
