Debitas NIGHTMARE - any advice??

Hi folks,
This is my first post...so forgive me if I'm posing this in the wrong place. However, I'm pulling my hair out with Debitas, so hoping someone can offer some advice.
April 2007 I received my Capital One credit card statement and found two transactions that were not made my myself. Both transactions were for small amounts of money, and made in Germany of all places. I instantly contacted Capital One (and spoke to one of their highly inefficiant ethnic call reps) to dispute the transcation - they subsequently sent me the paper work. Once they reviewed my notes they decided that these transactions must have been made by me as I own the card, and as such am responsible for the transactions that take place on it, despite the fact I explained I don't own a passport, so couldn't possibly have made these transactions in Germany. To cut a long story short, I have been hounding Capital One for over a year disputing this transaction, to no avail. After 10 months of charges for being over my limit (as a result of the two disputed transactions) I made a one of payment of £130 and informed them that unless the charges stopped, and the dispute was honoured I was stopping my minimum monthly payments.
Since I made this decision, they have continue to charge me for being over my agreed limit, and now for not meeting my monthly minimum payment. I now owe a total of £380, and have been placed in to default. As a result of this, Debitas has now began hounding me for money. They are calling as much as 10 times daily...on my mobile and home phone. I have explained the situation to them several times only to be met with threats and hang ups. I have instructed them to stop calling me on my work mobile, and my home number, and to instead contact me via letter only. They refuse to accept these instructions and continue to hound me all day, every day.
I have no intention of paying a bill that was not a result of my mismanagement...but...I am sick to death of dealing with this rude, harassing company!
Can anyone offer any advice as to what steps to take - or how to stop them from calling me all day every day??

Is any of the debt owing on this card as a result of your own usage?
Have you tried to report the fraudulent transactions to the police?If you've have not made a mistake, you've made nothing0 -

No, I have never been over my credit limit with the company. The last transaction made by myself left the card under the agreed credit limit. The following two transactions (ones not made by myself) took the card over the limit...hence the charges began. Despite the fact I disputed the transactions immediately, and continued to pay my minimum payment, they continued to charge me overlimit charges. And...it's gone on from then really....0 -
Oops...forgot to answer the other question. No, I have not reported them to the police, I reported them to Capital One direct, and then the fraud department as suggested by them. I didn't feel they were serious enough to report, as both transactions only totalled something silly like £20. Still, they have subsequently cost me over £300 in charges. I've paid 10 months of minimum payment (on the total balance, which included crazy charges) and paid a one off payment of £130 to clear my valid card usage. Still, this made no difference...as quickly as I paid the money, the charges bumped it right back up again.

You need to pay something towards the debt that you actually owe, each month.
The charges are reclaimable. Unlike bank charges, there is not halt on reclaim actions. So look at the front page here and get going.
Put in a formal complaint to Cap one and then forward it to the FO if it is not dealt with to your satisfaction.If you've have not made a mistake, you've made nothing0 -

That's the point, I've paid off what I actually owe. I've paid over £250 total to them, and my original bill never totalled £180. I am reluctant to pay anything further to them...especially as I'm now dealing with debitas and not capital one. Debitas is chasing me for over £380 and there is no way in a million years I will pay that amount of money. I have already paid above and beyond what I ever used...so, why would I want to continue paying them money, when they're already knocked back my disputes and requests for charges to be credited back to my account several (hundred) times?
