Advice if possible

Hi All,

I just want to say I love this site before I begin, Infact I read it every day, Ok my little story.

I have been paying Call Serve for what seems like years, infact it is, I pay £3 a month and my balance is still 159.56 it relates to Debt mangers LTD Admiral Insurance Services. I did have car insurance with these a few years back, but phoned to cancel and spoke to the alternative contact centre in India, She told me it would be £34.56 to cancel my policy to which I paid with a debit card.

Sorted I thought, so insured my new car with a new company and then months later got demands from Adrmial saying I owed a couple of hundred quid for cancelltion of my policy, I told them I had cancelled and had spoke to Inida and gave them the name and to check the calls, followed this in wrighting, anyway supprise supprise they say they have no trace of the call but just a payment and didnt hold a recording of it as it was there alternative contact centre, I was quite rude and told them to go and multiply as far I was concerned I had paid.

A few months later and my long term partner died and I alsmot had a breakdown to which I started getting letters from Call Serve and other places for debts that had started racking up as I was off work on SSP due to been heavily depreesed border line mental breakdown, anyway I went along to citizens advice and they arranged payment plans with everyone including call serve.

Fast forward onto today, I know I have been paying then and have acknodlged the debt, but could I still request a copy of my credit agreement from them under the consumer credit act, or is car insurance not covered by that ? I just dont recall getting a breadkdown of charges or anything from anyone to say how this money oweing was caculated, and there is nothing on any of my credit files for this, any advice on this would be of help,

    Hi BB. Sorry for your loss.

    You can request a copy of your credit agreement at any time. I would advise doing a CCA request, asking for a copy of the credit agreement, a statement of account and notice of agreement.

    I'm pretty sure Car insurance is covered by the CCA.

    I am sorry to hear that you have been through a rough time.

    You could give https://www.nationaldebtline.co.uk a ring, they can advise you on the best way to get the information you need. They also have a load of template letters on their website so you can use the text from those freely to make sure you say the right things in your dealings with debt collection agencies.

    Thanks all for the responces, Ill give it a shot, Ill send a request off they can only say no, can't they, once again thank you people, at least at 3 a month it will only take me a couple of years to pay back the £156 quid approx not alot I know, but what can one do, thank you everyone

    Batty, just 2 points i would like to stress with requesting a CCA.

    NEVER sign any letter you send to them or pay by cheque. You don't want them to have a copy of your signature.

    At the start of the letter make sure your declare I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY. Otherwise they may put the £1 payment towards the debt. Send by recorded delivery too so that you have proof that they received the letter.

    I know this is a daft question, If I put I dont ackowldge the debt, wont they just turn around and say, well you have been paying £3 a month for the last 2 years ?

    You put that at the top of the letter instead of "without prejudice". Something happened in a court case that made that statement almost worthless. It is just to show that if a judge sees the letter you are not admitting that the debt is yours and are asking them to prove you owe the money. By law they need to prove you owe the debt, you don't need to prove you don't owe it. Also the CCA must have certain things on it to be a legally binding document - if it isn't, then it's not enforcable.

    Mu husband pays for his insurance over a 12 months and that is under a CCA, if this helps
