Debitas NIGHTMARE - any advice??

Hi folks,
This is my first post...so forgive me if I'm posing this in the wrong place. However, I'm pulling my hair out with Debitas, so hoping someone can offer some advice.
April 2007 I received my Capital One credit card statement and found two transactions that were not made my myself. Both transactions were for small amounts of money, and made in Germany of all places. I instantly contacted Capital One (and spoke to one of their highly inefficiant ethnic call reps) to dispute the transcation - they subsequently sent me the paper work. Once they reviewed my notes they decided that these transactions must have been made by me as I own the card, and as such am responsible for the transactions that take place on it, despite the fact I explained I don't own a passport, so couldn't possibly have made these transactions in Germany. To cut a long story short, I have been hounding Capital One for over a year disputing this transaction, to no avail. After 10 months of charges for being over my limit (as a result of the two disputed transactions) I made a one of payment of £130 and informed them that unless the charges stopped, and the dispute was honoured I was stopping my minimum monthly payments.
Since I made this decision, they have continue to charge me for being over my agreed limit, and now for not meeting my monthly minimum payment. I now owe a total of £380, and have been placed in to default. As a result of this, Debitas has now began hounding me for money. They are calling as much as 10 times daily...on my mobile and home phone. I have explained the situation to them several times only to be met with threats and hang ups. I have instructed them to stop calling me on my work mobile, and my home number, and to instead contact me via letter only. They refuse to accept these instructions and continue to hound me all day, every day.
I have no intention of paying a bill that was not a result of my mismanagement...but...I am sick to death of dealing with this rude, harassing company!
Can anyone offer any advice as to what steps to take - or how to stop them from calling me all day every day??
Any help would be greatly appreciated!!!

Hi,
I know what people can be like chasing for debt, but I must highligh in recent cases for harasment, especially that Halifax one, anything over 5 calls a day is classed as harrasment, I would start logging times and dates and if possible get peoples name and extention numbers if possible, if you can advise them your recording the call as well, they will probably hang up at this point he he, but then you have evidence they have called, if over 4 just tell them politley you are noting how oftern they are calling and its harrasment and that you are contacting the police to report harrasment, if that does not stop them, do jus that, report them to the police, you may want to post this on the debt free wanna be boards as well0 -
Write to Capital One Conplaints depratment, outlining the situation and asking for a full refund of all charges, remove of the default, remove any adverse credit record entries etc.
Also say that you consider the repeated calls from their agent Debitas is harassment and will be include in your complaint to the FOB.
Say, if they are unwilling to do this then you require a final response letter so you can complain to the Financial Services Ombudsman... they have 40 days to comply.
Also send a copy to Debitas.
Obviously you will send it by recorded delivery and retain a copy.0 -
