Why Do I Have To Pay Back Incapacity Benefit

Hi

Do you have to pay anything back if you received your compensation while on IB although the compensation was for an accident at work which happened a year earlier and IB benefit is due to an unrelated illness.

From what Donna says you wouldn't have been awarded loss of earnings-if you are already on IB for unrelated illnes they could say you hadn't lost earnings.

Does anyone know if you are on incapacity benifit and you win appeal to get your pension on ill health grounds which usually includes a small lump sum does the incapacity benifit then have to be paid back ?

The lump sum would have no effect on IB. If the pension is over £85 per week there will be a deduction of 50p in the £ for anything over £85 unless you are on higher rate care DLA.
