alliance and leicester advice please

hi

I opened a direct saver account for my wife at the AL in dec 06 with 50k. she is a none taxpayer, and she has not had any problems with this account.
after sending a r85 to AL the interest was paid gross monthly into her nominated account.
On the 1st April this year my wife opened a esaver account at AL paying 6.5% and transfered and the money across from the direct saver. this was done on the telephone so the money was transfered the same day so no loss of interest there.
on completion of this telephone conversation with AL my wife was assured everything was now completed and nothing else to do.
when interest was paid to her in may tax had been deducted so, my wife complained about this to which the reply was you need to fill out a r85 she
told them that this was done on the direct saver account. they said that a new r85 was required as this was a different account and had to be registered seperately. this is accepted as 50% AL fault for not telling her when she did the transfer and 50% our fault for knowing this information.
AL sent her a r85 this was returned to AL 1st class post 7thMay in their own
prepaid addressed envelope.
after sending various secure emails asking for confirmation they had received
this r85, upto the 15th may they said they had not received it.
my wife telephoned AL and was told that AL had lost this document could we send another one. so, to save time we suggested faxing this document this was accepted. my wife telephoned AL approx four days after this fax was sent AL said they had received it but it was not exceptable because they had to have the original and not a copy.so my wife posted another one and after sending various emails she received a confirmation email from AL on the 29thMay clearly saying;

We have received your completed Form R85 and your account has now been
registered to receive interest gross, without the deduction of tax.

her interest was paid into her nominated account today 5/6 and AL have again deducted tax.

after a telephone conversation withh AL today they are saying that the r85 has been registered to the account today 5/6 and the email my wife received on the 29thMay should not have been sent.

they are telling my wife to reclaim this money from the revenue but why should she do this and wait 12months as it is their incompetence that has caused this problem in the first place i have suggested to her to close the account.

what would you suggest?

thanks
regards
jcl

I have several accounts with the same provider, and have always had to submit R85s for each one. It is entirely up to the individual (not the provider) to ensure this gets done, as they don't know your particular circumstances.

In your case I'd wait until the A&L were definitely paying the interest gross then apply to HMRC for a refund. It's a waste of time (IMO) getting A&L customer services involved. They don't know their bottom from their elbow half the time anyway.

    thanks for your reply debbie

i have an email (of which i have a copy) from AL which clearly states that my R85 was registered to my account on the 29th May. my interest payment
was on the 5th June so there must be something i can do about this as i have it in writing from AL that my interest should be paid gross.

    regards

Well, best of luck, but I doubt you'll get anything sensible back from A&L CS.

Its not worth the headache chasing incompotant people even though you were 50% to blame. Is it a fixed 1 Yr at 6.5% or notice account? My advice would be put your money with, Kauphing, HISAVE, etc all paying over 6.5% but only put the 35K in max, personally that would give me more satisfaction than trying to get stupid people to understand their mistakes LOL
