capquest phoning me

sorry i know there are loads of threads on crapquest but i want some advice please.
first telogram sent a letter saying basicaly confirm your address which thanks to info on here i ignored.
then i got another letter saying much the same thing but form capquest which i also ignored. couple weeks ago i had yet another letter, but this one saying i owed "jdwilliams" £157 and if i didnt call them and pay up by 30th of may they would start proceedings and send bailiffs.

since i dont owe anyone any money (i paid of all my debts when i sold my house in 2003 except one loan whose insurance was paying it), have no credit or store cards, i ignored this too.

now they are calling me, on my mobile so they dont have my landline number. not knowing who it was i didnt answer the other day, this morinign they rang at barely 8am and i was still half asleep so answered the phone. i was awake enough to refuse to tell them anything other than yes they were talking to me until they told me what it was about. he got rather snipey with me and told me to go look capquest up on the internet as it was a very urgent personal matter and they needed me to confirm my details for security, and once i looked them up i would have some idea what it was about.

now i wont be phoning them back, im not paying money for phone calls about a debt i do not owe, but how do i gte them to either go away and leave me alone or proove to me that i have a debt in which case i will pay it? there was nothing on my credit ref files last year about an unpaid debt (except a ccj i have no memory of but thats another hassle to be sorted eventually).

    Short answer, no.

    The only way i know of to get them to stop harrassing you is by asking that all communication is by letter, but for that they would need to know your address - which you don't want to give them.

    As you have already received a letter from Capquest, you may want to send this letter - if you send any (from nationaldebtline). I know you don't have an account reference, but should they write to you about a specific debt you caould send or amend this letter.
    Dear Sir/Madam

    Account No: 123456789

    You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

    We would point out that we have no knowledge of any such debt being owed to The Loan Company.

    We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    We look forward to your reply.

    thanks george, i think i will send that letter. they do have my address, its just that i have not confirmed it is correct so next time they phone i guess i shall give in and tell them to not phone again.

    Dont speak to them on the phone. Put a block on that number on your phone if you can. Send them a letter saying you will only deal with them in writing. Dont be bullied. Check your credit ref again. Just in case they have slapped you with a default. They do tend to do this sometimes x x x x

    Signature - because if, in the future you demand a signed copy of the Consumer Credit Agreement to prove its not your debt, then it is "possible" that some dodgy so and so at their end, could "copy" a signature they have on file for you.

    These people have designed the site very cleverly it is designed to verify your identity while gathering as much information as they can about you
    Information your NOT obliged to provide them
    You do not have to disclose previous address data, phone numbers etc.
    You should create a yahoo mail account to use for these agencies so they cant trace your actual account, then use a cloaking system, they also log ip address afaik to help trace you through service provider records
    If you have an agreement with bt broadband & your ip flags as bt, bt have done a credit check, well do the math..........
