Quick question re: 'letter to debt collection agencies'

Hi All,
in the letter to debt collection agencies should the letter be addressed to the DCA even though in the address it says 'loan company'? (daft question - just want to be sure)
I've currently got Equ idebt chasing me for £4.4K an amount I really don't recognise (I agree I do owe the some money but nowhere near this) on behalf of Na twest from 4 or 5 years ago. 4 weeks ago I rang the bank with the number given by the DCA (who now claim they would never give out numbers!) and the bank promised to send out paperwork relating to the accounts within 21 days. So far nothing. Had DCA on my back as I had started paying them £100 a month and asked them to hold for three weeks whilst bank sends everything through and I can check details. So after them demanding I pay them last night, I refused and told them I would be getting in touch with them on Thursday. By 'getting in touch' I'm assuming sending the 'letter to DCA' will suffice.

Hi Spike. Not too sure what the "letter to DCA" is, but i have a question.
Could the debt be statute barred? If you have not made a payment towards the debt for 6 years (5 in Scotland) and not acknowledged the debt in writing, the debt is unenforcable. Payments made to the debt after this time does not alter it from being statute barred.
Are you requesting a copy of the customer credit agreement (CCA) from the DCA? If the debt is a loan or CC debt (not an overdraft), then i would advise doing this. There are template letters available if this is not the letter you are referring to.

Thanks for that! Unfortunately I have made payments to them, mainly because they kept hassling me. Yes it is a copy of the credit agreement letter which I've found here. I just wanted to check that I address it to the DCA not the bank. also after telling them I would contact them on Thursday they've already tried phoning me today! Ahhhh0

Ignore the phone calls - there is a template letter somewhere to get them to contact you in writing only.
If it is the DCA that are trying to get money from you, then you should be sending the CCA request to them.
Don't forget NEVER sign any letter you send to a DCA and only send postal orders as payment (so they don't get your signature from the cheque either).After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

This is just a make believe scenario and no company would ever contemplate such a thing - honestly.
DCA charges you for a debt and is happy to be getting loads of money from you. :j
You stop paying them
They're not happy
You request a copy of the credit agreement :eek:
After looking online to find out what these are, they see that they have a CCA for another client :cool2:
They have use of a graphics package at the office :laugh:
The CCA is scanned in
The written details are removed
They scan in your letter requesting the CCA
They print this off and write in the remaining details that are blank :cheesy:
They now have a CCA with your signature on it. :shocked:
They send it to you demanding payment and threatening court action etc :huh:
Do you pay? :undecided
There was a thread i read recently which seems to have followed some of the above - only difference being that the lady in question had got married since taking out the loan. :laugh:
The letter was signed using her married name, but the loan was taken out in her maiden name.
