Item not as described

Hello

I have received a top and skirt advertised as size 14 but when they eventually arrived the skirt is a 16. I sent a message immediately to the seller but have had no reply. It is now 3 weeks since I bought the item.

I thought they might be on holiday so have given plenty of time for them to respond. They have been leaving feedback from the 2nd of this month so I know they are back but have had no reply to the 3 messages I have sent.

In the 70 or so transactions I have been involved in as buyer and seller I have not needed to leave negative feedback and don't like the idea of doing it.

I could re-sell the skirt but the top is a bit below standard. Any suggestions how to proceed with this? I will lose out £ wise whatever I do.

    I agree. Start the not as described procedure. If you paid by paypal you should be fine. Send both items back to the seller recorded so you have a tracking number as paypal will ask you to do this anyway

    Why should you re-sell at your expense? Email the seller again saying if you do not hear back in the next 3 days, you will leave negative

    You shouldn't have to do that to recover your money, it is not your fault.

    Did you pay by paypal? If so, then you can file an INR, but you will have to return the goods and by a trackable service, such as recorded delivery. You will then need to provide this to paypal, who will then find in your favour. You will get back your purchase price & shipping, but you don't get the return costs refunded.

    Just remember when doing this, what is it you want to achieve? Normally, it is your money back, some people seem intent in getting one over and this just antagonises all parties. Best to keep it civil and focus on getting your money returned.

    (a) Keep it and leave appropriate feedback
    (b) Open an Significantly Not As Described (SNAD) dispute

    If you paid via PayPal, you'll likely get all of your money back (less return postage - some sellers will refund that as well, although they are not required to (except in certain specific cases that probably don't apply here)). You may well get your money back if you didn't pay via PayPal, but there are fewer guarantees.

    Personally, I'd file the SNAD on principle. Also, don't worry about upsetting the seller - you have given them time to contact you and anyway a SNAD doesn't need to start off as a shouting match, it can just be another way of politely bringing to their attention that they cocked up :) .

    EDIT: Note that you cannot file an INR (item not received) as you have received it, even if it wasn't what you were expecting. To file an INR would be fraud. Also, do not send it back without first opening a SNAD dispute.

    I think to start an item not as described might be the only way of getting the sellers attention by all accounts
    And then hopefully all will be amicable on the op situation

    Not worth risking a warning from ebay for feedback extortion, if you want to leave a neg leave one, don't threaten someone with one.

    Thank you all for the information and responses. I am still relatively new to this Ebay lark and on the whole I am enjoying it immensely:D

    I did pay using paypal so it's not so bad.

    It's good to have somewhere to come in times of stress, and I will follow your advice.

    It would be better if all transactions were ideal but I suppose this isn't always a fluffy bunny world, heyho! :D

    Update

    Seller seems happy to refund but at £3.80 recorded delivery to return I will be that much out of pocket.

    Would it be ok to ask seller to refund that too? It's not my fault.

    If I ask she wont because she doesn't have to, will I be able to leave a neutral or does that no longer apply?

    Feel done over. Any advice appreciated.

    You could ask her to refund it but thats up to her really, if she is a decent seller then she would. You need to weigh up the cost of keeping it and reselling it against returning it at your expense - from experience, I was better off keeping an item and selling it (and it went for more than I paid!) then the cost of returning it.

    You can leae whatever feedback you like, the seller can't leave you anything other then pos though. (or none at all).
